K-1 interview: Red flags in Kiev:

Timeline

I met my GF on 2 January - we spent 3 days together.

Pretty much love at first sight.

We were introduced by my AirBnB hostess so IMBRA is not an issue.

She is an English teacher so language is not an issue.

I am well compensated so finances will not be an issue.,

Daily contact in Viber and we talk every weekend in Skype.

I am not providing ongoing support and I am disciplined about that.

I asked her to apply for B2. We will meet Valentines weekend in Kiev: I hope she can get the interview in on that trip.

If the B2 is approved then we can develop the relationship at a more normal pace.

Since it is likely to be disapproved I am thinking about going straight to a K-1 after only these two meetings.

We will have a couple more meetings before the interview of course. A week in May in Kiev and I plan to spend two weeks visiting her family in July (near Nikolaev).

Other potential red flags:

30 year age difference. She has a 5 year old son.

I helped her complete the purchase of her apartment. This is a huge red flag to me so I assume the CO will see it in the same way.

My divorce was final in September 2015. We were informally separated for two years before that and we have the separate addresses (3000 KM apart) to document that.

How good are our chances at the embassy assuming the interview is late summer (8-9 month relationship)?

Thanks

Let's say you have a very good friend who was in a very similar situation, and you are not.

Having fully considered his tale, what would you say to him?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Go for it dude - you are not getting any younger.

That is exactly what my friend told me.

But I want to know what the CO is likely to say.

Has anybody in a similar situation made it through Kiev recently?

Documented "face time" with her might prove to be important.

Furthermore, even though Kiev has not been known as a tough embassy, I'd be on the premises when the K-1 interview is ultimately held, to add credibility and to be around in case the CO has doubts or questions.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That is why approval for the B2 would make this so much more plausible.

As a teacher, she can spend a lot of face time here in the USA.

Depending on how long she can stay away from her son.

However you can, find a way to gain "face time."

Other potential red flags:

30 year age difference.

Not necessarily a red flag unless she is less than about 30 years old.

She has a 5 year old son.

That actually is better. Where is the father? He will need to complete a notarized approval for the son to immigrate to the US, permanently live there and then return to visit to UA and return to the US. Get this before filing since it is a deal breaker.

I helped her complete the purchase of her apartment. This is a huge red flag to me so I assume the CO will see it in the same way.
How would they know? No necessarily a red flag.

My divorce was final in September 2015. We were informally separated for two years before that and we have the separate addresses (3000 KM apart) to document that.

OK, what about her divorce? Or never married?

How good are our chances at the embassy assuming the interview is late summer (8-9 month relationship)?

Very good chance. My wife and I had only known each other for 3 months before we filed.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!
