Hello people. My girlfriend is just a few months away from turning 18, I am only 2 year older than her. I've been trying to figure out if I can petition a k1 visa even though she isn't 18 yet. Could someone please tell me if it is possible. Thanks

Sure, you are able to petition for her, but why not wait the few months? She must be legally free to marry where you will marry. If you marry in your state, and your state requires parental permission for those under 18, then you need that.

Thing is she maybe pregnant, and I will be traveling in 3 months to see her and speak with her parents. And I would like to get this done as soon as possible, and also because the violence is just getting out of contro in my parents and my girlfriend's home town.

The problem is, unless her parents will be present at the wedding, chances are you won't be able to marry someone who is under 18. However, if it's only a few months, the k1 normally takes about 6-8 so you should be fine. If you're wanting to be married BEFORE the baby is born, I highly suggest getting married now and doing the CR1 visa route. It takes longer, however you could likely pass on citizenship to the baby if you meet the presence requirements.

She must be legally free to marry in the state you are planning to marry when you file the petition. So she has to be legal on the date you file the petition.

Be careful. There was a recent poster who brought his 17 years old fiancee to the US on a K-1. They could not get marry in the US because she needed her parents to be physically present to get marry as a minor. Her parents were in her home country.

Check to make sure you can actually get marry in your state and city. You can not take her to another state to get marry.

Or make sure she is 18 during the time she is here on the K-1.

She will be 18 on may 30th of this Year, and I figured she would be 18 by the time the petition is processed. And I will call the court and ask before I file.

Hi,

Go ahead and file for the K-1 visa. By the time she interviews for the visa, she will be 18. The K-1 process will take more than 5 months on average.
