Hi,

My fiance received his passport and visa, he was unable to get the CFO sticker before Christmas.

Now they tell him that the Visa is expired because his physical examination expired on December 24th!

What can we do about this?

Thanks for any information.

I think you should be asking the consulate what to do next. They might be able to allow redo of medical exams.

Didn't he have his passport with him? I am asking because you said "they told him that the visa is expired.."

Medical examinations conducted in connection with immigrant visa applications have a maximum validity of six months and must be valid when you enter the U.S. The consular officer shall limit the visa’s validity to a period of validity of the medical examination. If the alien cannot arrive in the United States within six months of the date of the medical examination, the alien must repeat the examination.

Contact USEM informing them of your situation and SLEC to reschedule your medical. You will need to pay another fee(s).

The medical is valid for a year. The visa is only valid for 6 months, and for the Philippines the clock starts the 1st day of the medical.

The medical is valid for a year. The visa validity is 6 months, starting with the 1st day of the medical ... and this why new medicals are required by 6 months if a person has not entered the USA.

I knew that. The medical is one year and therefore you can use it after marriage for the AOS. But the visa is 6 months and the clock starts ticking when the medical is completed.

But wasn't what you said ;)" Medical examinations conducted in connection with immigrant visa applications have a maximum validity of six months "

Only the visa has a 6 month maximum validity, only connection this 6 month "thing" has to do with the medical is using the start date of the medical.

Thanks all for your replies.

I called the embassy in Manila and they told me to email a request to support-philippines@ustraveldocs.com

For a replacement visa, we were not given enough time, given the Christmas season vacations causing the

inability to get the CFO sticker in time. My fiance received the visa on Dec 18, and it expired on Dec 24!

Hopefully this will get us another chance to try. Again thanks for the replies.
