I'm the petitioner and submitted the K1 application petition May 20 2015. It's over 6 months now and it hasn't moved from the NOA1. On Nov 17, I submitted a ticket online requesting information. Today this is what I got..."We recognize your interest in a final adjudication on your pending application/petition and are aware of the difficulties caused by any delay in processing. The California Service Center is committed to processing this workload, and will be making every effort to adjudicate your case in an expeditious fashion."

I guess we just wait unless you guys have another suggestion. We are still hopeful but I felt compelled to reach out to the VJ community tonight on my walk home.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, we've called twice. First time a little more than 5 months after the NOA1 and spoke to a tier 1 agent which opened a ticket. I got a letter in the mail two weeks later that the petition is pending an adjudicator. The second time I called I asked for a tier 2 agent and he summed it up that it is pending, couldn't tell me a reason, an adjudicator will get to it soon, and 5 months is just an estimate that it can take much longer.

I think my paperwork is solid, just waiting isn't easy.

Today I finally got an email from the USCIS! They are mailing a Request For Evidence letter and listed will be the item (s) needed to support our petition. Funny how a RFE has made me happy but it did because now at least I know that an adjudicator is working the petition. I wish I had found the VJ community when I put together all the paperwork back in May! I see from old posts that others would wait and wait for months and then get a RFE and it all worked out...so we still have hope!

Yeah usually RFE's are pretty easy. Forgot to check a box on a form or forgot to send something.

But it means they're working on it! I wonder if they had lost the darn thing, it's been so long.

The request for evidence (RFE) means that something wasn't included or signed in the petition. I should have the letter in the mail soon and it will tell me exactly what they need. This is the definition from the VJ website:

RFE's are typically issued for questions regarding:

  • lack of supporting documents
  • clerical error(s) on the filed petition
  • windows in legal stay in the country
  • information that may be lacking from the petition that is needed to adjudicate the case, including an Affidavit attesting to the bona fide nature of the relationship.
  • marriage/birth certificates and English translations
  • evidence of Eligibility (I-797, Notice of Pending/Approved I-130/I-129F, Evidence of Nationality, etc.)
  • I-693, Medical Exam/Supplemental I-693, Vaccinations


RFE does not contest lack of payment, or missing forms.

I that it just happens and others with Bosnian fiancé's processed quickly . I found other VJ posts where they heard nothing for months and then get the RFE, almost like it gets set aside until they come back to it much later just to ask for more evidence.
