I met someone online who got married 5 years ago to a person who is here on a work permit. I directed her to this site but she has concerns. She has been married and divorced multiple times before marrying this last man who is here on a work permit. if she follows guidelines it states she needs to submit divorce certificates. Does she need to submit every divorce certificate or just the most recent priror to getting married to her now current husband?

Ok i told her. she says she was married to an illegal once but after 3 years he ran away to mexico. and no she never applied for a green card for him. Apparently he was married in mexico. What can she do? she just figured it wasnt a legal marriage to begin with so never did the divorce? what are her steps now?

So he was already married in Mexico when she married him? Does she have proof of that? I believe that if he was already married at the date of their wedding, the marriage is considered void and no official court annulment is necessary, but marriage laws vary from state to state and she'd need to confirm what the laws are in the state she was living in at the time.

If she just thinks he was already married at the time of their wedding, but there is a chance that he was not, then obviously there's a chance that she's still legally married to him and that her present marriage is bigamous.

She needs to clarify that her current marriage is legal and valid before she even starts to think about petitioning for her husband's immigration.

Her next steps should really include talking to an attorney.

If the divorce to the illegal is registered in the US, she needs a lawyer to straighten out the problem

thank you for the feed back. she is going to talk with a lawyer to clear up her past first before they proceed. he is still employed but layoffs may be in the future.
