Wedding Certificate vs. Wedding License

Hello,

I entered on K1 visa last Saturday and everything went fine until tonight; we were planning the Hawaiian wedding on April 15th, and just found out that the marriage certificate is issued to us in 4-6 weeks after the marriage in state of Hawaii.

This is way too late for us since I need to file for AOS by the last week of May at the latest.

Do you know if there is any way we can expedite getting our wedding certificate in Hawaii?

Any other options?

Can we use the marriage license instead?

You need to send them a photocopy of the "Certified Copy of the Marriage Certificate". The marriage license does not prove you got married, so you'll have to wait for this to arrive. Alternatively you could file with the license and see what happens, you might get an RFE, you might not.

That said what the big rush in filing AOS? You know you don't have to file before your K-1 expires right?

Yes why the big rush to file AOS? You only need to marry inside of the 90 days, but you can file for AOS any time after. Many wait until either getting their marriage certificate, or after filing income taxes to have a better affidavit of support.

Just wait for the marriage certificate to arrive, and then file for AOS.

You will most certainly get an RFE if you send in the marriage licence, instead of the certificate.

In Washington state, we were allowed to get the signed certificate after our wedding ceremony from the judge that married us and take it to the court house the next business day ourselves (instead of the judge mailing the certificate into the court house herself). We got two copies of the marriage certificate at the court house while we waited. They were very cheap, if I remember correctly, like $5.00 each.

Maybe you can do the same in Hawaii.

You probably shouldn't be making travel plans before you've even filed for AOS. Things can go wrong in the process, especially if you file for AOS without the correct documents, for example filing without the proper marriage certificate.

Yes, not filing AOS and then leaving the country was a horrible move for us. It can really screw things up.

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

So you want to file in May and have AP by the end of June? It takes at least 90 days to get that.

As for the marriage certificate, you need that. Not the license. The license does not show you married.

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
