Hello it's my first time, I have 2 questions

1 I am the petitioning for my wife I have 2 kids that live with me in the states who I claim on my tax. But I also have 4 US citizen children who live oversea with my wife who I don't claim on my tax should I include my 4 children who live oversea with my wife on the household size part 5 or just me my wife and the two kids that I claim on my tax

2 if I have to include all my children and my income is not good enough can my friend be a joint sponsor if he lives in a different state

1) Yes, you need to count any unmarried under 21 children, regardless of where they're residing.

2) Yes, as long as the joint sponsor is living in the US, over 18 and a LPR/USC.

Your household count includes all minor children no matter where they live or who claims them on a tax return, anyone else that you claim as a dependent, and the intending immigrant.

The joint sponsor must meet the income requirement for their household count plus the intending immigrant.

The problem is I haired a lawyer but it was a law firm and they kept changing lawyers this one is my 5th one with them the first one told me you have to include all your children the second one said no me my wife and the ones i claim on my tax but I think you are right am sorry but it have 2 more questions

1 since my lawyer send the I 864 with only my 2 children me and my wife to nvc and now I got am interview coming up should I file a new one and have my wife take it with her and explain what happen is that gonna be a problem and can I do the explaining my self

2 I am a Yemeni American I went to yemen and the war started so me and my family escaped the war to Djibouti and we gonna have an interview here and I been hearing that the co here are telling people that the joint sponsor have to be from the same state. Can they do that

1) Yes, have her bring a new I-864 and the joint sponsor's I-864. Make sure they meet the income requirements.

2) Are you sure that this is why people have been refused visas? That's not something the CO would refuse a visa for and it may just be rumors that you've been hearing. Unless they show you a piece of paper from the embassy stating that's the exact reason for a visa denial, I wouldn't believe it.

Thanks you said make sure they meat the income requirements you mean the joint sponsor right? Because my I 864 won't be good enough my joint sponsor makes 32000 and it's her and a son and my wife because she the only one in my family immigrating is that correct

And on the joint sponsor one person told me the co told him he need a joint sponsor from the same state I asked to see the slip they gave him it was a white slip that said 221 g and the comment the co wrote was ( needs a joint sponser from ny)

But when I sake him to explained what happens he said the co told him where is the joint sponsor and he said ny but his joint sponsor is in Colorado and that his brother who is the main sponsor is in ny state do you think the reason that the co told him to get a new joint sponsor from ny is because he didn't know where the joint sponsor lives and do the intending immigrant needs to know who and where the joint is thank you

Yes, sorry, I should've been clearer.

Hmm, yes, it may have been due to the fact that they didn't know where the joint sponsor was from. Do you know what visa they were applying for? For K-1, the sponsor requirements are determined by the embassy.

I would advise that the intending immigrant review the forms that you send her and have some general knowledge about the joint sponsor.

Thanks again I don't know what visa they applying for but I he told me it's from his dad who is a us citizen and he not marry am sorry but I have 2 more questions

1 I am going with my wife to the interview and we have to explaine why we change the 1864 you think it will be ok

2 you think I should try to get a joint sponsor from my state or go with the one I got from a diffrent state the thing is most of my friends and family live in California and ny and it's easier. For me to get a joint sponsor from ny or California

Hmm, okay, that's strange...

1) You should make sure the embassy will allow you to attend the interview with her since there are many embassies who are against it due to crowding issues. Providing the new forms at the interview should not be a problem.

2) I know for certain that joint sponsors from other states are accepted [happened in my aunt's case, we live in NY and joint sponsor was from MD] and the I-864 states that they just have to be living in the US.

But, the other person may have been denied due to other reasons such as misrepresenting and answering the question wrong by saying his joint sponsor was from NY when he's from colorado.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
