I'm sure this question has been asked before, but I searched and couldn't find a recent answer. I have not yet filled for a K1 for my fiancee yet, but she is talking about wanting to come here and visit for 10 days. I planned on sending in the K1 next week, but now I'm not sure if I should wait and fill out a tourist visa application first? If that is better, how long should I wait after submitting the tourist visa app before I send in the K1 app? Also, how long does it take to get the tourist visa? I think she shouldn't have any problems getting it, she's been to many other countries, she has a job, a car, and a daughter that she would be leaving behind. Ideally I'd like to send both apps in at the same time, but I've heard on other forums that's not a good idea because they might think she'll stay in the country on a tourist visa. But the info on this forum suggests otherwise. I just don't want to waste my time and money on a tourist app just to have it denied.

I think the chances of your wife getting a tourist visa with a fiancee in the US are very small. But you never know until you try. However, why would you want to delay your K-1 visa process by trying for a tourist visa first? You guys have met in person at least once during the last two years, right? The K-1 visa process is fairly fast, so if you get going now, she could be over there with you in six months.

There's no real reason not to try for the tourist visa, except for the costs involved, but probably best not to get your hopes up too high that it will be approved.

But then again, she might be one of the lucky ones.

But when you listed out all those ties to her home country consider this, how strong are those ties really considering that you're planning on her moving to the States in the near future anyway?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

I think the chances of your wife getting a tourist visa with a fiancee in the US are very small. But you never know until you try. Not really, lots of people have left children behind with a plan to apply for the kids greencard as soon as possible.

Not saying that's your plan but unfortunately the actions of people before you can weigh against you.

Nope, children aren't ample proof. And 6 months is nothing in immigration time

How would that even work? If a woman comes here on a tourists visa, how would they even be able to get a green card for a child? I mean if they are here as a tourist, and overstay their visa wouldn't that mean they are here illegally and wouldn't be able to bring anyone else here? Or is it possible to come on a tourist visa, get married, and be able to bypass the whole K1 process and go straight to the adjustment of status step??

It's odd, I had a woman from Moscow visit me several years ago, she had no problems at all getting a tourist visa. And she told them she was visiting someone that she had an online relationship with, and she had no kids, no car, but did have a really good job.

I'd recommend you to try the tourist visa first, me and my bf are planning on getting married next year, we haven't started our k1 process yet.

You'll never know 'til you try, it really doesn't matter if you have a car, lands, savings, etc. but the fact that she has a child back in her country it is a good family attachment, also I realized that it doesn't really matter if you have been working for 1 month or 5 years at your current job. Also, if the applicant has no intentions to stay in the U.S (in this case illegaly) it really shows, telling the truth, being polite, and in my case "smiley" makes you confident.

I just got approved this past tuesday, I recently graduated from college,no kids, I'm 28 yo, my boyfriend is in the U.S (I stated in my application where I was going, for how long, adress and his name) , I've been working in my current job for almost 3 months, I'm a remote bilingual Interpreter, and I hardly make $500 usd per month (I'm from México and our currency is going down each day), but you know what? I don't have ANY intentions to stay in the U.S, when you are confident about the information you've given to the consul it really shows. There's a reason why they are there, they are trained to detect threats to their country.

Documents are not really requested but it doesn't hurt to take them with you to back up your answers, I saw consuls requesting for documentation to some people, getting denied and approved as well. So, you'll never know til you try. If it doesn't work then it's time to apply for the k1.

Good luck and tell your girl to be friendly, to smile a lot, and most importantly have confidence in herself. :rolleyes:

I have been reading more about this, and it is possible to marry on a tourist visa (as long as that isn't the intent of coming here), and file for AOS. I've read it's advisable to wait at least 30 and preferably 60 days before getting married though. And it's also advisable to not leave the country before getting advance parole. Problem is that could take another couple months, and her daughter is only 5, I don't think it would be good for either of them to be apart that long. If we do get married after 30 days, what are the options for getting her daughter here ASAP?? Would adoption work?

I don't know about the daughter issue, but I'll be honest with you, because of people doing that (getting married on a tourist visa) is the reason why people like me and many others struggle to get one, I spent 3 slepless nights and $10,000 mexican pesos on the trip, visa fee, expenses,etc.

If that's really going through your mind right now, I'd advice you to go for a k1, that way your fiance and her girl wouldn't spent so much time appart.

'no intentions' yet already asking questions about how to bring the child over....sheesh....leaving a minor child behind is NOT a STRONG reason to return...after all, she will leave the child anyway for a period of time...and a 3-4 month 'vacation?'...Really? Russia awards 3 month paid vacations to their employees? Since when? And if she can leave the kid for 3 months, why not 9? or 12? Answer: there is no answer..

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
