My husband, the principal sponsor is currently unemployed so his sister, who is in the same principal address has agreed to be the joint-sponsor and we badly need help in plotting the numbers on the “Sponsor’s Household Size” part of the I-864 Affidavit of Support Form.

Questions:

1. She and my husband is using the same principal address, so do we put “1” on item number 7?

2. Who needs to fill-out I-864A form? My husband? Or both of them?

3. Do we need to put “2” on item number 5? (She listed her parents as her dependents but they have been residing in Taiwan)

4. The Household size should be “5” right?

5. Should both (the principal and joint sponsor) need to have the same plotting on this part of their I-864 form?

Your husband fills out form I-864 because he is your sponsor. However, his sister has agreed to help him sponsor you, so his sister needs to fill out I-864A because that outlines the agreement between the two of them. His sister would be counted in item 7.

We were given the same advise by the others. we will go ahead and do that. thank you so much. :)

Husband has zero income so the joint sponsor should do an I-864 as well as the petitioner. Reason being is that the joint sponsor is not making up a shortfall but rather supplying 100% of the income. Using the I-864 gives a clearer picture of the joint sponsor's situation. Why risk a delay / rfe when you can do it better the first time?

Any sponsor must include in their household count any person claimed as a dependent on their most recent tax return. Also, minor children, no matter where they live or who claims them on a tax return, must be included in the household count.

Husband and sister each do an I-864 with all the required documentation.

Husband has zero income so the joint sponsor should do an I-864 as well as the petitioner. Reason being is that the joint sponsor is not making up a shortfall but rather supplying 100% of the income. Using the I-864 gives a clearer picture of the joint sponsor's situation. Why risk a delay / rfe when you can do it better the first time?

Oh..so if that's the case, if my husband fills up his I-864 form, where does he plot the "1" for his sister? on item #7? and same with his sister? or will he be counted as a dependent?

then what should be the total household size on their forms? 3 for my husband's and 5 for his sister's?

Living in the same home does not necessarily make them a part of one's household for the I-864. Follow the form instructions.

I'm sorry cz this plotting is just a bit confusing to us that's why we ask to get direct answers.

From what I understand in your advise: (please correct me if i am wrong)

In my husband's I-864 form, he should only count me and himself since his sister is not his dependent and since they are not just combining their income to support me. Which gives a total of 2 household members

In my sister-in-law's I-864 form, she should count me, herself and their parents because they are her dependents and should not count my husband. And therefore her household size is 4.

Did i get it right?

yes, she listed them as her dependents on her most recent tax. Are you saying my husband should also count them on his household size? pls be more specific on whose household size you are talking about.

Also, my husband was able to file tax for the most recent tax year but just too small. Does ths matter?
