Immigration reviewed 864, and now they want W2??

Hi there,

I submitted i-864 for both of my parents. However, I didn't work 2014 year and I didn't use my husband's salary because he doesn't make enough. Instead, I ended up getting a co-sponsor, my brother in law, that qualifies. My husband and I did joint taxes but he was the only one that worked.

Immigration has reviewed my 864 and technically speaking do not require us to submit anything directly to them. However, they do require form my W2, that my parents should take to the interview, but I didn't work. What are they suppose to take?

Since you did joint taxes and you didn't work, NVC assumed that all the income on the tax transcript was from you and is asking you to submit W2s to verify this.

Even though your husband didn't earn enough to sponsor, you should've provided an I-864A and his W2s. That way, they would be able to match up that the income is only your husbands.

You could provide an I-864A and your husbands W2s and then provide a letter saying that you are not employed and the income specified in the 2014 tax returns is all from your husband.

I understand. However, the NVC letter I received said they will proceed forward with the interview. All they want, is my parents to bring the W2, in the case, my husbands to complete the process. Therefore, I don't need to submit the 864a, correct?

You as petitioner submit an I-864 regardless of income. If you use an IRS transcript then that is all that is needed. If you submit photocopies of tax returns then you must include all supporting documents which includes W2's. Since you sent the 864a from your husband it seems that they are looking for the W2.

Also the same applies for the joint sponsor re: tax returns/transcripts, W2's. Be sure that all the needed items are included with the brother in law's I-864 as well.
