Husband was DENIED VISA today??????

On 10/7 my husband and I went for our interview, we were giving a slip that states we needed a co-sponsor (which I thought was odd being that I make over the required about per the government guidelines) and he was advised to come back on today 11/5. My husband returned today and he gave the co-sponsor affidavit and was told to wait. He waited for hours and was the last of three people there. The white co with initials km advised him after reviewing our pictures she wasn't convinced our marriage was real. ? I follow this site and quietly did EVERYTHING that others failed to do. Any piece of evidence that could've been turned in I did. Chats, emails, video logs, western union scripts, my insurance info, post cards, letters, affidavits of acknowledgement to our marriage... There was nothing missing...I currently cover him on my Athem bluecross blue shield medical insurance... He's the beneficiary on my life policies, hell, we even have our names tattooed on each other. But she states after viewing our pictures she isn't convinced our marriage is real. Dear God... ?

The main issue seems to be how much time couples have spent together, is that an issue in your case?

I wish that was an issue at least I could make some since of what happened today.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I WISH they would get rid of that KM! She us ruining our lives. Someone said get your senator involved. I wrote every senator, district attorney, governor, even Obama...they all responded (cause they have to) but they all said there was nothing they could do. So that was pointless. You jut have to wait 6 mos to get the denial letter and appeal. At least that's been my experience. If anyone knows if there is anything we can do in the mean time, please share. 6 mos is going to drive me crazy.

I WISH they would get rid of that KM! She us ruining our lives. Someone said get your senator involved. I wrote every senator, district attorney, governor, even Obama...they all responded (cause they have to) but they all said there was nothing they could do. So that was pointless. You jut have to wait 6 mos to get the denial letter and appeal. At least that's been my experience. If anyone knows if there is anything we can do in the mean time, please share. 6 mos is going to drive me crazy.

It depends on what you expect your senator to accomplish.

For some it has been helpful in requesting a second interview or to locate their case and inquire exact status when they had no idea

if they are in AP or had been returned to USCIS.

A senator can not override the consulate's decision but can request and inquiry on the petitioner's behalf if the consulate refuses

to respond through email.

You don't appeal a returned case, you respond to the NOID/NOIR letter you receive from USCIS in a rebuttal and submit more

evidence. If USCIS revokes (it seldom does) the returned petition, then you can appeal IF you have overwhelming solid evidence that

they made a mistake in their findings.

Right now there is nothing to appeal.

You do have to wait 6-12 months until you receive the NOID/NOIR letter, depends on how long the embassy "sits" on it before returning

the petition. Contacting a senator while the embassy sits on it can be useful with a short and sweet " requesting to return the case now "

request without any long drawn out emotional noise that side tracks the immigration liason. Either the CO keeps a case in AP for investigation

or returns it, sitting on it for months should be questioned through a senator.

It depends on what you expect your senator to accomplish.

Is the NOID/NOIR letter the letter my husband was given when denied? How would we respond to it?

No, you were given a 221g. Once your case has been returned to USCIS it takes 6-12+ months to get the NOID/NOIR letter from USCIS.

You have to respond to it within 30 days.
