hello fellow Visa journey mates,

I am new to this board so if I am writing something odd please forgive me.

I am someone who is suffering from husband's severe mental abuse (There used to be additional financial abuse too before I got the EAD).

He petitioned I-130 in this April so I have done with biometrics and gotten EAD in my hand. I have already started working so finally I became to be able to buy some food and to pay the day care fee for my infant but it is still very hard (The day care in NYC is extremely expensive. Your pay check is literally disappearing almost just for that). However I am very determined to leave this abuser for the sake of my and my daughter's mental health. So I want to divorce ASAP.

So here is my questions, if I file the VAWA:

1) Can I skip the background check since I have done with the biometrics?

2) How can I transfer the priority date?

3) How I maintain my current EAD

In the case of a withdrawn form I-864 your Adjustment of Status will be denied and consequently you will be removed from the USA

If you file VAWA before cancel the affidavit of support (form I-864) inform asap the USCIS field office where the AOS was filed that you have a pending VAWA and ask them to hold the I485 until final adjudication of the VAWA case,that being said you will have your work permit valid and you will not need to file a new I485, in case your VAWA is approved.

You need to attend therapy (5/7 sessions) and have a psychological evaluation done to file VAWA.You need police clearance from all places you lived in the past 3 years.
