F1 Engaged to U.S Citizen Can I travel Aborad

I recently got engaged to a U.S Citizen. I am on a F1 Visa. My family wants me to come home for Christmas however I am now thinking I cannot do that If I plan to eventually do AOS? My last entry was in March this year when me and my now fiance went to mexico for Vacation. Is there any way I can travel back and not have issues when adjusting for status when I return? I also was planning to do OTP on my visa so I could work for the year after I graduate in May.I know the F1 is a NIV however I would really like to go home and we do not want to rush the whole process. Options?

Hmm, so you care currently enrolled as a student? And will be attending school up until May, correct? If so, I don't see why you can't enter with your F1 visa since it is valid as long as you are registered for the semester.

You would only be able to adjust status after you get married. Do you guys have a wedding date in mind? You guys could always adjust status next year, before you graduate and your F1 expires. After you adjust status, I believe it takes about a month for you to receive the EAD/AP combo card which would let you work and travel.

F1 is a non immigrant visa, like a B.

My concern is, that when I re enter in January, and apply for AOS say in May or June, will they not give me trouble at the interview for entering on an f1 in jan with intent to apply for AOS? They will ask us I presume at the interview when we got engaged...

Maybe someone else can chime in here, but you didn't initially obtain your F-1 visa with a preconceived intention to immigrate. But, I see why you think there may be a problem. Hopefully someone who knows the laws surrounding this or went through this themselves can comment.

If you are already on an F-1 visa, like I was, and you return on that visa to continue studying and you also happen to have gotten engaged, there is nothing to worry about.

An issue would have arisen if you applied for, received, and then used the F-1 visa SOLELY as a means to enter the country and adjust your status.

If you were not engaged and went home for Christmas, weren't you planning on returning on the visa anyway to continue school? This is a non-issue! Relax :)
