Hello all, Im a new member but long time lurker here (:

Im a US citizen who filed an I130 petition for my Indian husband. I filed back in July so I still have some time left before I find out if my petition was approved (there's a 5 month processing time for the Nebraska service center.) I sent in all the required documents, including our marriage certificate, pictures of our wedding, one of our wedding invitations and 3 witness affidavits. Im a bit worried this wasn't enough to prove a real marriage though. My husband and I were married in March and we haven't joined our bank accounts, or leased an apartment together or anything of that sort yet, and Ive been reading around and seeing people say that's what they want to see, and lack of such evidence is one of the main reasons a petition is denied. This has been worrying me a lot lately, Im already an ocean away from my husband (during our honeymoon phase none the less!) and Im just a mess haha. I just want to be with him again.

If anyone is in or has been in such a situation, or has any general advice for me, that would be really helpful, Im so stressed out over all this stuff.

July 17th 2015: NOA1, petition forwarded to Nebraska

July 21st 2015: NOA1 Hard copy received

January 5th 2016: Petition approved!

February 2nd 2016 : received NVC welcome letter along with case and invoice number

August 13th 2016: AOS package review complete and visa interview scheduled for Sept 27th 2016!!!

Our I-130 didn't include any joint bank statements or leases. I think the evidence that matters most is what shows that you've spent time together.

While I am a K-1, I wouldn't worry about it too much. BEcause I will be in the same boat when it comes to adjustment of status. I already own my own house and cars and what not so there really isn't a LOT that i can do jointly with my soon to be spouse. I am one to think that love can show through a man's body language and I am going to gather that the consulars can read body language. There is just soemthing when a man describes and begins to talk about his wife that is amourous if it is real. Again, this is just me talking here, no experience. I think if you have evidences of communications for lots of time and time together, that it should be ok. Think about it, most american citizen couples have prenups, post nups, separate accounts etc, if that is the standard, a lot of people don't have bonefide relationships. I really think it would come down to your fiance's expression at the interview and if plaved on AP, the reaction afterwards. Good luck and stay up

Joint accounts and co-mingling of fiances isn't something the CO expects at interview you don;t live together. Your evidence you submitted is enough for a petition. No worries there.

If there is more evidence you want to add after your approve petition gets to NVC you can add with your IV package we call that "Side-loading". Than bring the rest and updated evidence to interview.

So don't worry you did good. Maybe add some communication evidence later IM, Text, Skype, Whatsapp, and phone logs, Gifts sent, and pics with friends and family.

I wouldn't stress out too much. While you wait for I-130 approval or an RFE, start collecting evidence of your relationship. Is your marriage registered?

No one expects the two of you to have joint bank accounts or apartment leases living a world apart.

You should compile a set of your communications as evidence of a bonafide, continuing relationship as a married couple. These include phone logs, skype chat logs, text messages, emails, etc. Also keep records of pictures.. together, and\or with family.. any trips together.. flight itineraries, boarding passes, hotel receipts, etc. Also a good idea to send each other gifts\birthday cards by mail. Anything that shows the normal "things" husbands and wives do.

Will do (: Now when you say emails and text messages, are they focusing more on the actual messages or just the dates? Because there's some pretty personal stuff in there and I'm wondering if I can cross some of it out and just show them dates messages were sent and so on.

That is beautiful (: I believe the same thing, though I get a little worried because my husband tends to get pretty anxious during interviews.

I would actually leave the personal stuff in, as you want USCIS to see all aspects of your relationship, especially the good and personal stuff.

What you want to leave in or out is your call.. focus on frequency and modes. Short regular chats look a lot better than a once a month chat. Embassy makes the final call on a visa, and you want it to be fully convinced your marriage and relationship is real and continuing.

You didn't respond to the earlier question if your marriage is registered.

I was in the same situation. I included affidavits from his sister and my sister. Then I just added in skype/facebook/whats app logs. I went through and took out the stuff that was really really personal but left the normal stuff in I also did pics from all my trips, western union receipts, receipts for our wedding rings, plane tickets. Just look around and include anything both names are on.

I was very nervous because I didn't feel I had enough official proof but I was applied shortly before the 5 months.

In our case, we did not send any evidence proof at all with our I-130 petition. We had no problems at all with it getting approved. Everything else that everyone is saying above, though, is what my husband took to the embassy.

Also, quick question, are you, the USC, of Indian descent or other? I know this may sound personal, but I ask because I, myself, am of Caucasian descent and there were issues at my husband's interview because of this. We had literally everything plus some that everyone above listed. But, since I am white and our marriage was not typical to cultural norms because of that, the officer had a hard time believing that my husband's family was accepting of our marriage. Because of this, we ended up with a 221(g), and we had to include sworn affidavits (plus any other bit of evidence that we could find that we did not include at the first interview) from his parents describing their relationship with me and their approval of the marriage. So, if you fall into that situation, you may want to consider having something like that whenever you do go to the interview at the embassy.

The affidavits and such put that in your petition up front. We call it front loading. You do not know if a CO will even bother to see evidence at an interview. And putting it with your petition now it is approved by USCIS.

Yes, when I sent in my petition package I included our marriage certificate, 3 affidavits, pictures of our wedding (and the other ceremonies) as well as pictures of me with his family and one of our wedding invitations. I was worried this wouldn't be enough to have our petition approved.
