Hi all,

My husband and I are planning to file AOS in the next few days. We were married 7/24/2015, he arrived on K1 visa. I have some questions:

1. Now that we are married should we file AOS and wait until he receives EAD to apply for a Social Security card? Or should we get a Social Security card now before we file AOS? I know that K1s are eligible for SSNs, but now that we are married, does he still qualify? His I-94 expires September 28, 2015, FYI, so there's still time to apply for the SSN if we are eligible.

2. While we wait for his green card, what is his immigration status? I ask because in order for him to get a NYS identification card, he needs to be a lawful permanent resident at least, which he won't be until he gets a green card. Right?

I feel like I have done something terrible wrong by not getting his SSN sooner.

Go ahead and get the SS card now. I do not know the exact term for the status while you are waiting for your AOS to be approved. Each state is different but it sounds as you will have to wait on the ID. Where we live my wife could apply for a learners permit once she had her EAD card.

Get the social security card as soon as possible. My husband came with a K1 visa and once we received the EAD card we were able to get a NY State id without any problem. We just needed the social security card, proof of address, and ead card.

My husband got a NYS driver's license very fast; he needed to surrender his old license, then he needed his SSN, his passport/visa, his I-94, and proof of address. No need to be a lawful permanent resident but you need to be a resident of NY; we weren't even married when he applied. You can still get the SSN but you should hurry, from September 14th and forward (2 weeks before I-94 expires) they won't let you apply until you have an EAD.

AP: 33 days

Total: 258 days
