My wife has been outside the country for 11 years, the CO officer only gave us a blue sheet saying to fill out the I-601, nothing was ever said about the I-212.

We are in the process of filling out the I-212 just to be safe, she got a previous 5 year ban, 11 years ago. (expired 6 years ago - along with her lifetime ban)

Do we have to fill out the I-212? All her other bans are served.... but the lifetime bar she obtained.

Section 212(a)(6)©(i) of the Immigration and Nationality Act


In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.


I-601 would be for overstaying previously but I am not sure if that's required since she's been outside the country for so long.


Consulting an attorney would be a very good idea.

Someone already messaged me and gave me the advice I was looking for with proof to back it up. Please, stop being so rude to people. People come here asking questions and to get opinions, for what others have already been through. Last thing people want is to be badgered by someone browsing the forums all day.

I am glad you got the answers you seek.

In your previous posts I was very nice to you and offered you sound advice and even shared my story with you.

Hire a lawyer. I am not a jerk, I am honest, if you do not want honest answers, then go to another forum.

You have a very complicated case, attempting to solve it on your own will almost certainly end is disaster.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
