Hoping to file ASAP, as the 90 days started on the 17th of July. But there's a few questions I have about my packet.

  1. We're planning a trip to my home country for about a month in December so my folks can meet their granddaughter/niece. From my understanding, I'll be granted an extension on my conditional greencard for a year. What happens, then, if I'm approved whilst traveling (for ROC), thus my 10yr greencard is printed? Can I enter the US still with my one year extension temporary GC?
  2. Would this trip be something to include with my ROC evidence to further prove a bona fide marriage?

Depending on the service center it can take 4-12 months for a ROC petition. Sometimes longer.

Be aware that you will have biometrics about a month after you file that you must attend or reschedule so have someone checking your mail.

You can travel with the letter, passport and expired card until the letter expires.

When we traveled we made copies of my wife's I-797 Extension Letter, placed the original in a plastic page saver sleeve, her unexpired passport, her expired GC, and a copy of our marriage license. The copies were for comparison to the original and giving to the border control officers as needed.

1. CSC currently takes 4-6 months to approve cases. If you're approved, you might want to carry the 10-year GC on you since the law states you have to carry your GC on you at all times. If your GC arrives in your address while you're away, can you ask a friend/family relative/neighbor to Fedex/UPS it to you in the foreign address? Aside from that, keep in mind you would have to have completed your bio appointment before traveling. Also, just in (the unlikely) case you're scheduled for an interview, be prepared for that so ask someone to keep an eye on your mail for an interview letter.

2. if you're traveling together then yes, the booking would be a beautiful piece of evidence to add to your ROC paperwork.

Thanks a lot, all. I think, if the trip is to be in December, I should be in the clear of biometrics. The only dilemma is I'm approved whilst on vacation, which probably isn't a dilemma after all.
