Hello everyone

This is my first post so please forgive me if it isn't in the right thread.

My fiancee sent the I-129F petition on the 14th of May to the Dallas Lockbox and we still haven't received NOA1. He called USCIS twice to ask if everything was alright and he was told that they are trying to resolve the issue of piled up application. As I've seen here the petitions currently processed by TSC are dated December 16th.

Is there anything we can do? Do we just wait? I am frustrated and discouraged :(

How did your fiance pay? How was the petition sent? Most NOA1s take less than 2 weeks. I think the person on the phone thought you were asking about the NOA2.

My first clue something was happening was when my personal check was cashed.

He payed with a money ordered and the petition was sent by a consulting firm. My fiancee is their client. He just sent them the petition to check everything is in order and they sent it. He called twice and each time USCIS said he should get a response in the mail in 2 weeks. This is the second week since we last called.

We've considered sending it again this time with a confirmation number and the package complete because the first time we only sent the petition. Do you think that would be a good idea?

Have you used the Money Order receipt to see if it was cashed? That would be a good indication that your petition was received.

unfortunately he doesn't have the receipt anymore. is there any other way to check?

Maybe you could call USCIS and ask to speak with a Tier 2 representative... I'm not sure if that would help without any type of reference number but you could try? The first people you speak to usually give very little and at times incorrect information. You should definitely have received your NOA1 by now...

Did you submit a G-1145 form to be notified via email/text?

He called again today and I think we're going to resubmit after all. the uscis rep said they'd refund him if they get 2 money orders. it's unfortunate that we waited this long. we didn't know what to expect otherwise we would have done something sooner. it's the law aid firm that messed things up.

If you have no red flags in your case, it is quite simple to do on your own as long as you can read and follow directions. Most people here complete the whole process independently without legal aid, it saves a lot of money and usually time, as a lot of lawyers give incorrect information and it ends up costing the people more time. Let us know if you need any help.

I'm not sure about them refunding you, I've never heard of them doing that... especially if they touch two separate cases. If it's a money order and you do not have the receipt, you will never actually know if they ever cash that money order and the new one as well. Did you speak with tier 2 or just a regular representative?

guys

thank you so much. after all the trouble we had we finally got our I-129F approved and now our case is forwarded to NVC. I have one concern sincer it only took 23 days since our NOA1. My fiance is currently looking for a job because he moved to another state and we're really worried about the affidavit and not having the necessary documents(paycheck stubs etc) in time. Do you have any suggestions?

Would he need a cosponsor? If so what would the income of the cosponsor have to be?
