Hi everyone,

My husband and I got married early last year. We had a baby in December 2015.

We filed I-130 in September 2014 while he was a US resident.

I-130 was approved in March 2015.

He became became a US citizen in May 2015.

We mailed NVC May 2015 asking them to upgrade petition to Immediate Relative category.

We filed the I-485, I-765, & I-131 in June 2015.

We are now awaiting receipts and other communication from USCIS.

Anyone else with experiences in situations similar to mine ? I would love to know how your experience/timeline went.

09/12/14 - I-130 mailed (while spouse was permanent resident) to USCIS CSC
09/15/14 - I-130 receipt date
09/18/14 - NOA1 received
02/15/15 - NOA 2 received (approval)
03/15/15 - Letter received from NVC indicating priority date not yet current...

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

since you sent stuff into USCIS,

USCIS will request the casefile be sent to them from NVC. It takes some time, under 2 months,

but AOS processing won't stop, yer in a queue, waiting until your casefile can come in front of an adjudicator with USCIS.

Expect an interview.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

since you sent stuff into USCIS,

USCIS will request the casefile be sent to them from NVC. It takes some time, under 2 months,

I am not sure what 2 months wait time Darnell referred to, but my case--similar to yours--appears to go the same route as anybody else's AOS filed concurrently with I-131 petition goes--without any delays or expedition. First, you submit almost the same docs with USCIS for AOS packet that you filed with your I-130 and with NVC (actually USCIS requires even less documents than NVC does). So there is no need for the USCIS to request your case from the NVC. Second,, your IR1 is absolutely separate process. For instance, in our case, while we have been waiting for the AOS approval, NVC scheduled an interview for our IR5 visa, which we did not attend due to AOS process.

So far what I see, I-131 approval received prior to AOS package submission definitely does not expedite your AOS process.

05/08/15 - online status changed to "Case is ready to be scheduled for an interview"

05/18/15 - online status changed to I-765 approved-wait the card in the mail (no change for I-131) (80 days)

05/19/15 - received EAD/AP in the mail

05/28/15 - online status changed to "As of June 28, case is ready to be scheduled for an interview." This is the second time of such change since 05/08/15.

07/05/15 - online status changed to "As of July 5, case is ready to be scheduled for an interview." How many times are they going to update that status, I wonder?

12/18/15 - still waiting!!! For almost 9 months now (261 days from AOS NOA, 234 days from Biometrics).

01/14/16 - submitted "out-of-normal processing time" inquiry and called USCIS that stated the case is still at NBC and "inquiry" should answer why there is such delay.

01/15/16 - 294 days since the AOS was received by the USCIS; 262 days from the biometrics.

01/28/16 - [day 309] received response to case status inquiry (processed on 01/23/15) - "your case is waiting to be scheduled for interview," so wait another 90 days [sigh].

02/21/16 - [day 332] interview scheduled for 03/24/16 [363 days from the receipt of petition].

02/24/16 - [day 363] AOS interview. Approval on the spot.

Considering the 4th of July holidays, it will be some time before you hear from the USCIS.

I found your case interesting, because your I-130--when approved--placed you in F2A category of relatives that requires quite a bit of wait to get reviewed. But then at the time of filing AOS, you were an immediate relative. There is an interesting article to read on the subject: google "Upgrade Petition when Petitioner Becomes U.S. Citizen." (this website does not allow me to give you a link).

I also hope that you explained in your cover letter to I-130 why your AOS petition claims you as an immediate relative (i.e. no wait in line like spouse of a permanent resident) and that you are now in the US; otherwise, you cannot adjust your status.

BTW, it takes NVC usually about 60 days to respond your inquiry, so you possibly will hear from them in July.

I just now received notification from USCIS that my case has been accepted and forwarded to NBC for processing... FINALLY !

Yes I have reviewed many forums regarding upgrading petition and so on... and I did included a letter indicating why im now an IR and will adjust status.

07/24/15 - Email and text notifications of acceptance received (petition forwarded to Nebraska SC) 

 

*****This visa was approved for my daughter in June of 2016. She came to the US in July 2016 and received her 10-year green card in the mail.

I forgot to update. Will add the dates soon***** 

 

I-751 - Removal of Conditions 

07/24/17 - I-751 mailed to USCIS > 08/09/17 - NOA Received > 09/04/17 - Biometrics Appointment (I think I did a walk-in in August for this) 

01/22/19 - Update on website says green card being produced
