Just wanted to share our story. My spouse and I were married in the US two months ago. I'm a USC, and he is not. He was here on his OPT, he left for his home country and had to go to the embassy in his home country to get his J1. He listed that he was married to a USC on his DS-160 application. He J1 was approved without the 2 year rule and got the VISA in a weeks time. He was able to enter the US without any problem at the airport tonight.

The moral of this is that there is A LOT of fear mongering on this site and others about "immigrant intent." I even had an immigration lawyer tell me the chance of him getting the J1 was 0%. As long as you're honest you'll be fine is what we said and it worked for US!

11/02/2016 - Interview Scheduled for 12/01/2016 !!!

12/01/2016 - Interview date (Interview cancelled on 11/18/2016)

01/12/2017 - ACTUAL INTERVIEW IN ST. Louis (need to get new medical submitted)

01/19/2017 - New medical dropped off at USCIS & CASE APPROVED ! I-485 & I-130

01/25/2017 - GREEN CARD IN HAND! - DONE!!!!!!!

11/25/2018 - Mailed I-751 packet to Dallas address

11/28/2018 - I-751 packet showing as DELIVERED to USCIS in Dallas

12/04/2018 - Check cashed 

12/19/2018 - I797 NOA received in the mail (18 month extension) - Vermont Service Center

12/17/2019 - New Card is Being Produced (approval following day and card mailed on 12/20)

"If you're honest you'll be fine" is as poor advice as "he had 0% chance of getting the visa".

His odds for approval of the J-1 were lower being married to a US citizen, but not 0. Equally, plenty of other people have been in similar situations, been honest, as it was not "fine" for them.

I know not everyone has the same expeirence. People worry about just having a boyfriend/girlfriend in the US. We actually declared that we're married on the DS-160 and apparently the emabassy had no issues with it, they didn't even ask him about it.

His J1 is a J1-Professor VISA for a major US university. He's been in the US for almost 10 years now on various student VISAs while getting his PhD.

I also used to say I was visiting GF when entering as a visitor, now this was before I joined VJ and never had any issues.

And vice versa.

Not sure why you would think he would have an issue visiting, seems to have pretty solid credentials.
