Hi fellow VJ members,

I just have a question and I was just wondering if any of you have experienced/knows someone who experienced where they applied for K1 visa(NOA2 has not been given yet) but along the way decided to do get married and apply for the K3 visa. I would like to know if there is any negative effect on the application process. I'm not planning to do it but just wondering if anyone has done it. Thanks.

It has come up, not a K3, but CR1.

Pull K1, Marry file CR1.

Hi,

Lots of people have decided to marry while filing for the K-1.

There is no switching from a K-1 to a K-3.

Furthermore, the K-3 requires filing for a CR-1 spousal visa. Most likely, the K-3 will be administratively closed when the I-130 is approved for the CR-1.

If you get marry, you will need to cancel the K-1 and start all over for the spousal visa. That will be one year.

The glaring question. Why? Starting over at this point can add a year to the wait as you can not start the IR/CR-1 visa (K-3 is sort of obsolete) until married and have the NSO document (CEMAR)

People have done it but the K-3 is being phased out. You would have to withdraw your K-1 and married and refile as a CR-1 adding almost another year on your journey. It's not recommended but hey, you can do as you please.

Hello fellow VJ members,

Thank you for all your response to this topic, I have no plans in doing it unless my application gets rejected (just got an RFE yesterday, but still thinking positive) that will be my next option (I guess). I was just asking because I was just wondering. Me and my fiancee agreed to respond to the RFE and wait and see, I don't think our application will be rejected. Again thank you for your replies.
