Hi everyone

So I am in the US legally and my two kids are back home. I am married to a US citizen and we are about to adjust my status. We are planning on filling together with my kids since they are minor. So my question is will the procedure be the same for me and my kids? And noticing the processing time is usually 4 months for AOS can my kids get their visa in the same time frame? If not what is going to happen?

Your spouse will file an I130 petition for each of you. Yours will include the I 485 for AOS , the kids will process at the embassy in about a year.

This will not be over quickly. You will not enjoy this.

For clarity how old were they when you were married and is their other parent in agreement?

To Boiler: they were 7 and 5 years old and yes their father is in agreement

To Darnell: I used a tourism visa which is B1 B2.

To nigeriaorbust: ok well noted but are you sure it will take that long??

About a year is as good a guess as any, your spouse would need to file for them and they will interview in their home Consulate.

Lat time I noticed adjustment cases seem to be taking circa 6 months.

We are planning on filling together with my kids since they are minor. So my question is will the procedure be the same for me and my kids?

1. you : file for adjustment of status - I-130 + I-485 plus the other forms.

2. kids: chase a visa, husband files I-130 , NVC does doc intake, then an interview is scheduled for the visa. probably a CR-2 visa type.

I suggest filing the stuff for the kids after you receive the receipt notice on your Adjustment of status stuff.

The good news? We have GUIDES on this stuff, in the GUIDES section - be certain to review it when logged in from a PC, as studying from a handphone is absolutely abysmal for real research here.
