is there anyone else waiting for FBI to get background check done? it has been 7 months since my fingerprints appointment and 8 months since filing. I still have not heard back from USCIS. I've done infopass but was told my name check was not done yet. i asked them if they know how long it will take, they said no. i asked them if its gonna take years, they said no. but it feels like the wait is endless...

so I reached out to USCIS asking for the stratus of my case since I have been waiting for about 8 months since fingerprints. Here is what they said.

"Due to workload factors not related to your case, USCIS anticipates a delay in completing your case. USCIS is committed to adjudicating immigration benefits in the order received and in a timely and efficient manner. We regret any inconvenience that results from delays in processing."

did anyone else get the same message? Does anyone have any advise?

Note: My case is at Texas office

Yes, others have reported getting the same message.

It is utter nonsense. If the delay was due to workload issues, then how are they continuing to clear background checks (FBI) and approve applications (uscis) submitted long after yours? What it likely actually means is that they don't have the time to figure out what's holding up your case... that's just my guess.

I would recommend writing to the uscis ombudsman next. You should also write to your representatives. Look at the webpages of your two senators and your congressperson and see if one of them has a staff member dedicated to immigration issues. If there is one, write to that person. If not, write to all three. You may get the same response, but these inquiries sometimes result in action on a case. If none of those things work, your choice will be to either wait or take legal action... It's probably too early for the latter as some people wait over a year.

One more thing... sometimes contacting uscis, even when you get a meaningless response, triggers action. This is because, I think, it causes them to look at your file after many months of having ignored it. They may realize that you are ready for an interview now, even if they sent out a standard "give us more time" email/letter. So don't get your hopes up, but check your status and see if it changes in the next week or two while you are researching yiur next steps.

We are in the field office I see. They cancelled my interview in November and upto today, they have not rescheduled yet they said 30-45 days. Today is exactly 120 days since they descheduled it. It is frustrating.

Our son took the oath and got his certificate yesterday. Nice and short ceremony (less than an hour) for about 80 people.

We are happy for him, but still waiting for our cases to move...

Did you contact your senator or governor? We got tired of waiting and ready to start nagging them too....

I would recommend contacting one of your two senators or your representative in the House, but a governor doesn't really represent constituents to the federal government in the same way, so I don't think that would be particularly helpful... well, unless you happen to be friends with the governor, of course! :-)

You can also try contacting the USCIS Ombudsman's office as a preliminary step.

Remember that if your background check is legitimately stalled, this won't help... but there are many cases where contacting these people does help, which tells me that some applications have just been set aside and forgotten even after a background check is completed.

This is the reply from our senator office. if you google the letter above, most of applicants get the same message after they contact their senator. It will not help a lot.

What can I do next?

Yep, that's a pretty standard reply. Now many times after such a reply, applicants find that they are placed inline. This is because (I think) USCIS sends of the standard reply, but then they take a look at your case. If they find that the background check has actually been completed, they'll place you inline. If not, I don't really know what happens; maybe they send a query to the FBI, maybe they just say "it's not our problem".

What I do know is that many applicants (including two in the last week or so here on VJ) were placed inline within a few days of inquiring (either themselves or through a representative). So what I would advise is that you give it two or three weeks and see if there's a change. If not, then your application probably really is stuck in background check.

Now if that's the case, then I'm afraid you just have to wait. A March 2015 applicant was just placed inline this month and it may take as long for you. Your only other option would be to hire a lawyer and try to take USCIS to court... I don't think you should even consider this until your application is well beyond all reasonable processing times (I would not do it before a year has gone by).

This is all just my opinion; if you're looking for expert advice, you'll need a lawyer. If I were in your place (and I might be soon since I'm waiting too), I would wait a month or so and then call USCIS and create another service inquiry. A month after that, I would write to my representatives again. If there's no progress by July, I would talk to a lawyer to understand my options.
