Need To Cancel 129-F/File for I-130

Hi there,

I'm hoping someone can help me out with this.

We filed for a 129-F and got pretty far along in the process when, because of family circumstances, we decided to suddenly get married on a trip to the US. We now need to withdraw our 129-F petition and file an I-130 via Direct Consular Filing.

My questions are:

Is there a waiting period between when we send in the letter to withdraw our 129-F and filing the I-130?

Is there something special I need to include when I send in the I-130, explaining about the cancellation?

Is there anyone who has actually gone through thism who can tell me what needs to be done? I've seen posts but they involve different circumstances or people who were asking if they should do it.

6/2/14 - Recieved by USCIS
6/5/14 - Check Cashed
6/10/14 - NOA1
7/5/14 - NOA2
7/21/14 - Letter Stating Packet Sent to Consulate

7/30/14 - Letter from Consulate
10/29/14 - Extension Request to Consulate

4/15/15 - Letter from Consulate

6/22/15 - Cancelled 129-f

6/24/15 - Sent I-130 to Frankfurt

7/1/15 - Notice of Receipt Rec'd

8/15/15 - Notice of Approval Rec'd (Packet 3)

9/1/15 - Packet 3 sent to Consulate

Not sure that's a great idea, since they'll be sending the I-130 to a Lockbox but the I-129F is already pending at one of the Service Centres.

Suggest sending to the petition cancellation letter to the respective USCIS service center processing the petition.

If they are doing DCF, then they are not sending the I-130 to a lockbox. They would be filing with the USCIS Frankfurt office. Though they can always send a letter to the service center that is handling their current I-129F.
