Said much more eloquently than I. Should he go ahead and file the provisional waiver before he leaves?

Yes, he should not leave until the waiver process is completed. I-601-A is different, was designed (mostly) for Mexican Nationals who did EWI and never returned to Mexico.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Everyone! Thank you so much for your guidance.

My spouse was filing for green card when his paperwork and original supporting documents were lost. He has copies of the originals. When he found out that his paperwork was lost, he was told that re-filing was not possible without the original supporting documents.

We will take some time today to go over all your comments in detail so we can come up with a plan of action.

Thanks again!

He is going to need original documents no matter what.

What was he filing for and how?

First before you do anything, if you know all his details, request for FOA, from USCIS, you get more information about him if his parents ever filled anything on his behalf. After you have that information, than you can proceed with any paperwork.

This is the greatest lesson a child can learn. It is the greatest lesson anyone can learn. It has been the greatest lesson I have learned: if you persevere, stick w/it, work @ it, you have a real opportunity to achieve something. Sure, there will be storms along the way. And you might not reach your goal right away. But if you do your best and keep a true compass, you'll get there. Edward M. Kennedy,
