Dear vj friends.

My husband and i are having a bad situation right now with nvc.

We received our notice from nvc last january 7, asking for the 60 day review of our papers, etc. On midmarch we received a checklist regarding my husbands i864. We applied for spousalvisa, we used his parents as co sponsors, as my husband is currently based in the Philippines with me and doesn't make much to meet the financial requirements. So,because of our situation, we answered his i864 tax information line with $000 since he hasn't filed taxes in the USA as he is not working there. We also attached an explanation letter as to why he did not have any w2s attached. However, last march they sent us a checklist regarding his tax information. We called nvc and asked why a checklist was given and told them about our situation and that we did what is required, which is write 0$ and attach an explanation letter.

now, the agent told us she can put it up for supervisor review and that it takes 42 days or less, we agreed. As it might have been just a mistake. Now, 45 days since our supervisor review, still no word from.nvx. we called them twice and same answer, its still being looked at. Then on the third call, rhe calls are spaced a week apart, one agent told us, it was never seen by a supervisor!! She put it up again on another supervisor review and its been a month, no word. We called nvc 2x since and even asked for a supervisor to make a return call to my husbands mom to get an idea but no call from nvc.

We are all very sad and discouraged right now and very frustrated as to what to do and who can we contact regarding this.

Please please please help us understand and advice us on this.

thank you!

I think it's time to bring out the big guns. Your husband needs to contact his congressional representative and start with them. They sometimes can move mountains. The topic and step by step instructions are contained in this forum. http://www.visajourney.com/forums/topic/505860-letter-to-the-representativesenator/

Please update us to your progress and what your doing to resolve this as others may come behind you and have the same question. Your history will be of help.

Good luck

that is why I always tell people to file your taxes even if you owe nothing. Living overseas does not exempt you from filing. I lived overseas for 4 years and declared taxes on my non-US income every year and did not pay a single penny. The cost to file was $0 as I did it by hand. It is a bigger headache to have to explain why you didn't file taxes instead of just showing that your non-US income is exempt, right?

So he filed taxes in the US? Unless he had no income overseas, he was still required to file US taxes.

He filed taxes here in he Philippines. His income was not enough to be required to file taxes in USA.

It seems like the one hour or two it would take to file his taxes would be a lot easier than having to "explain" the situation. Like it would literally take no time at all to do them and you would owe nothing.
