Hi all,

The VisaJourney AoS checklist for K-1 visa holders ( that " The fee for I-485 applications includes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication)."

But, I cannot find any evidence of this from USCIS. The instructions on Form I-765 say that there is no fee required for ©(9) category if it is a renewal EAD, only. If Visajourney is right, can anyone point me to an official source that verifies it? Or does anyone know from experience that Visajourney is wrong?

Thanks!

hi

the answer is where you go check out the i485

Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms together. If you choose to file the I-765 and/or I-131 separately after July 30, 2007, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of the filing of an I-485. If you filed your Form I-485 prior to July 30, 2007, you must pay the fees associated with Forms I-765 and/or I-131 when you file.

OK I found it -- the fee is NOT required. If anyone else is wondering, it's on the right column on page 5 of the Form I-485 instructions.

It states it directly on the USCIS I-485 page where you download the form and instructions. > http://www.uscis.gov/i-485

It states it on Page 5 of the I-485 instructions. > http://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf

It states it on Page 9 of the I-765 instructions. > http://www.uscis.gov/sites/default/files/files/form/i-765instr.pdf

NOTE: If you filed Form I-485, Application to Register
Permanent Residence or Adjust Status, as of July 30, 2007,
and you paid the Form I-485 filing fee, no fee is required to
also file a request for employment authorization on Form
I-765. You may file the Form I-765 with your Form I-485, or
you may submit the Form I-765 at a later date. If you file
Form I-765 separately, you must also submit a copy of your
Form I-797C, Notice of Action, receipt as evidence of the
filing of Form I-485 as of July 30, 2007.
