Oh okay. Thanks for answering. I just wanted to make sure because I'm wondering whether there is a case where this I-94 problem happened even though the return ticket got cancelled properly before.

I doubt that it is a hit and miss. I read every post in this thread and only one user (Avrora9002) said that "she thought she cancelled the ticket". But a few months ago she made a thread and it turned out that she did not contact the airline directly, she contacted the agency where she bought it and they just didn't cancel her return ticket. So I think when one cancels the return portion of their ticket by directly contacting the airline, this I-94 issue can't happen because they remove the name from the passanger list right then and there.

I agree about the thread, but I've had a number of private messages from people who have, and have not properly cancelled their flights.

I initially thought this was a BA issue, but other members have confirmed the same issue with other airlines.

But, no matter what your thoughts are, remember that the airlines are meant to send the I94 information to the US CBP based on the flight manifest; The flight manifest is (meant to be) based upon people (and indeed cargo) that is on the plane just a few seconds before all doors are sealed; In fact, the last person to leave the plane before it's sealed should be the person carrying the paper manifest.

My point is, if we were not on the plane, we should not have been on the manifest; if we were not on the manifest, they would not have reported it to CBP.

All that said, life is not perfect, and I can see the odd one getting through, but this thread, and the PM's I've had to go along with this thread have highlighted, to me at least, that this is happening alot.

Thanks for explaining. I really didn't think it could happen even to those who cancelled their return ticket by directly contacting the airlines before. Scary.

I dont think you should be too worried; my issue was my departure didnt happen.

If your arrival / departure dates are correct, I would think that would be ok

I called CBP and I was told my departure was mentionned on I-94 because they inspected me.

i just have my own corrected now, if you have the same problem, locate cbp office close to you and go with ur passport and ur form I-797, it will be corrected under 5mins, don't take a chance

No, but i guess they checked the stamp on ur passport and uscis receipt(i-797) he didn't even check my marriage license

I'm fairly certain that if your I-94 incorrectly shows you left but you're still here, then CBP will just take you at your word and correct it for you. Theoretically you could have left and then snuck back over the border, but I think it would take a special kind of insanity to do that in the middle of your process for a green card.

These situations are why, amidst the activity and excitement of arriving in the U.S., one should take the time to cancel the return flight by calling the airline, noting the time and date of the call, noting the name or ID number (or both) of the airline employee spoken to, and noting the cancellation number if one is given.

These notes should be filed securely with the beneficiary's other immigration papers. If the airline employee is able to generate an e-mailed cancellation notice, it's even better.

The above takes very little time but is extremely easy to forget to do.

I looked into this, too. It does not appear to be the right form for correcting I-94 issues.

If you wish to have personal records reviewed and/or corrected, please submit your request through DHS Traveler Redress Inquiry Program (DHS TRIP).

Mine is not local. The 2 nearest are both 2.5 hour drives each way & it requires me & my wife to take off from work a whole day to remedy. Her next step is calling them to see what they say because she already emailed them & all they said was go to cbp.gov, which is where we got their email address.

Went this morning to the local CBP office and had my situation corrected in about 5 minutes showing my passport - the officer typed something (I couldn't see the monitor so no clues) and commented that it is a very common issue with round trips; indeed the lady she spoke with before me had the same issue.

Now back to the forever wait for an answer from TSC..next week it will be one year from my AoS request, I'll buy a cake with one candle.
