Is the fiance VISA the quickest option?

Hello everyone. I wanted to first introduce myself! I am a new member as of 5 minutes ago! I am still working on uploading a picture.

My fiance is from Nicaragua and I am from Virginia. We are trying to decide if we should proceed with the I-129F petition or the I-130 Alient Relative petition. If needed, I could go to Nicaragua so we can get married ...we really don't have a preference ...Virginia or Nicaragua.

I would be filing at the Vermont Center. Is it true that the I-129 F Fiance VISA is processed faster than the I-130 meaning he could come over to the U.S. sooner? What kind of timeline are we talking about here?

Timeline

As from what I know and from what several timelines show here, the K1 really is the quickest option, especially when your Service Center is Vermont. I was approved within only 14 days (also Vermont) and had my visa within 3 months. However, I would say that it might take anywhere from 3 months to 6 months to get approved. The K3 Visa usually takes longer than that AND you would have to separate after the wedding again.

Removal of Conditions Timeline:

03/19/2008 - package sent to TSC, let's hope for the best

03/20/2008 - check cashed

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019

Timeline

Historically the K-1 was the fastest track. As I understand that is not the case any longer. The K-3 seems to be processed faster with less wuestion by immigration. There is a great push by the US immigration department to look closer at K-1 as it is believed these visa'a are more liely to be based on false intentions by the immigrant.

Visa Approved! Interview Completed.

Visa Delivered by DELBROS October 28th, 2006

October 30, 2006 Arrived back in LAX with Melinda, were going to Disneyland!!!

November 6th, 2006, Melinda and I are back home in Winslow Arizona loving Life!

I was told they're about the same. We opted for the K1 because I hate being apart from my fiance - it seems worse (to me) to be apart from a husband. the K1 visa process is annoying but it could be worse.

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

We are nearly there with our K-1 interview in 10 days, and I plan on being there with my fiance during the interview.

Ive heard positives about either or.

However, i can tell you that we decide to get married and then apply for spousal visa. they requuested more evidence of our wedding ceremony and asked for a list of attendants as well as their identification. Yesterday i called the embassy for an update and i was told that another letter requesting more info on wedding attendants was sent out. We are waitng for that letter, so i cant tell you what they are requesting yet.

my point being........the spousal route requires more proofs than the fiance visa. they are investigating the list of our wedding guests! its 5 weeks now AFTER my husband had his interview and it will be another 5 weeks till we hear anything. (it takes 4 weeks to hear back from embassy after we submit additional evidences).

thing is that i feel like our relationship is not one that should be questionable. we got engaged in July 2005 and got married oct 2006. i lived in his house with his family from may 06 until dec 2006 (i returned home for christmas with my family). his interview was in january.

someone getting a fiance visa wouldnt be required to proove marriage, just relationship.

so think about this.

i realize my experience is unique and may not apply to you, so i dont want to alarm you. However, i never had any idea in my mind that the embassy would investigate the lsit of those attending my wedding. i never even thought that our relationship is questionable, and now look where i am at.

There are lots of things to consider beside how soon you want to be together. There is immigration after togetherness and some of the 'hassles' of that process can be avoided if you can find patience at the front end of your journey.

Ah ...yes, what a helpful chart! Thank you so much. It's true--my main concern is that we can spend at least 6-9 months out of the year in Nicaragua because that is my employment ...I lead educational trips there and we want to be able to keep doing that together.

So, given what the chart implies ...maybe we should go for the spouse k-3 visa since travel is not restricted.
