Timeline

Hi All,

This is my first post and I am hoping to get some direction on my application.

1. On a k1 and applied for AOS - 06/14

2. EAD received in 08/14 with a 1 year validity

3. Interview waiver letter received - 9/14

4. No update on the AOS yet, contacted USCIS - 4/15, and was informed there is a delay but not pertaining to my case.

5. I have contacted my attorney for an extension of EAD and advance parole.

My question is, if they dont make a decision on the GC until next year (and i have my EAD extended), would I just get a 10 year GC since it would be 2 years for our marriage instead of a conditional Gc?

When was your actual marriage date? Was it in June of 2014 or was that when you applied for AOS? If you got married in June last year, I'd expect to get your GC before June 2016. And if you don't, I'd be be making some noise because two years for AOS is highly unusual.

K-1 from Haiti - NOA1: 5/27/2014; NOA2: 7/8 USCIS never updated to say that it was sent to the NVC (just in case you're as concerned about your status not updating as I was about mine)

Timeline

If you have been married more than 2 years at the time a decision is made, then you are supposed to receive a 10 year card. However, it is unusual for an AOS to take 2 years. Some are having to wait a wait a year or a little over, but not 2 years.
