I got RFE regarding my Fiance Visa that I had previously submitted:

Besides the RFE Page itself, there is another page that they request me to fill out:

Please check the appropriate box regarding if there is a new Form G-28, Notice of Entry of Appearance as Attorney or Accredited Representative.

Please place the new For G-28 directly under this sheet.

1. Yes, there is a new G-28

2. No, there is not a new G-28

My question is: I will try to submit the papers myself and not my lawyer. Is it ok if I send the RFE myself, and check the box, No, there is not a new G-28?

Yes, that is fine. We did the same thing and had no issues. We got approved roughly 10 days after they received our papers. :)

We only included one letter of intent to marry written by the petitioner. At the time we sent the initial petition we had a lawyer look over our papers and he didn't mention that it was necessary to include letters from both of us.
No big deal but it added more time to the process that is already taking way longer than expected.

Its sad to see how lots of the RFEs have been because of an incompetent attorney. So next time try to make everything by yourself with the help of VJ that way you dont spend your money. Best wishes :)

Germanese - I had the same issue as you! They received mine yesterday - So I'm praying/hoping/wishing that I get my stuff back in 10 days like you as we are TX too.

Good Morning All! Ok so, I'm kind of a huge worrier and I have a bit of anxiety on a couple things that I think I may have done wrong, after reading some of the things on here. I know every case is different! But, I'm going to list a few of my concerns, and can anyone who has gone through the same thing, either with or without problems, let me know the outcome! Just trying to prepare myself for any possible RFE's! Thank you!

1. For evidence of meeting, this is what I submitted...(do you think this is enough?):

Primary:

  • A copy of my flight purchase/itinerary printed from the purchasing website.
  • My boarding passes
  • A copy of the receipt showing that I had money converted into their money at the airport in Brazil
  • Two bus tickets from our travels together (I chose these, because the bus tickets are printed with names on them, so it shows that we both took the same bus trip at the same time).
  • A copy of the page from my passport with my visa on it, showing entry and exit stamps

Secondary:

  • 10 original color photos of us together, with our names, locations and dates written on the back.

2. As far as the G325A goes...we each filled one out...he signed it and then scanned it in and emailed it to me and I printed it out to submit it (instead of waiting the weeks it would take to receive the copy in the mail). I did the same for the fiance letter of intent to marry. He signed it and scanned it back to me

Is it going to be a problem that it's not an "original" signature in ink? Or is it ok, because it is his actual signature?

3. I don't have a checking account...so I sent a USPS money order. The thing that's worrying me is that, when you send a money order, it asks you to provide the address of the payee. I was confused because, even though it was sent to the USCIS, the money order is supposed to be addressed to USDHS (spelled it out on the money order). SO...I wasn't sure if the "pay to" address should be the USCIS address, or the USDHS address, so i left it blank.

I did call the USCIS to ask before I sent it, and they told me "it's up to my discression which address I put on the money order." My thought process was, I'd rather leave it blank, than to put the wrong address and have them not be able to cash it.

Thoughts??

4. How many passport pics did you all send? I read the instructions a million times and it says to send "a" passport photo (of each)...but I've read on here where people have sent 2 of each...I only sent one of each.

Thinking back now, I probably should have just sent both just in case...but wasn't sure if I was supposed to keep the second one for myself for this process somewhere down the road.

Thank you! Yes I'm a bit concerned on that too. I've gotten answers on everything else...just not sure about that part of it. Ahhhhh!

Hi Everyone...I found this online (it's an official USCIS "interoffice memorandum" it is from 2005 SO, I'm not sure how correct/up to date it is, but I have not found an updated version, so maybe this is still in effect. Regarding the G-25A signature I just asked about. Again please keep in mind, this is something I just came across online, and of course I'm sure the best bet is to have it signed! But this gives me a little hope that it's "ok" that my fiance's signature wasn't in ink. *fingers crossed*

"Previously it was standard practice to issue an RFE when the beneficiary failed to sign the G-325A and/or failed to submit photographs. From the date of this memorandum, an RFE should not be issued in instances where the beneficiary failed to sign the G-325A and/or failed to include photographs provided that the beneficiary is residing abroad. The beneficiary will be required to sign the Form G-325A and/or submit photographs at the time of visa issuance abroad. It is also not necessary to RFE for the petitioner’s signature on the G-325A, if the petitioner failed to sign it. The signature of the petitioner on the Form I-129F should be deemed sufficient for purposes of adjudicating the petition. Finally, it is important to note that the petitioner’s photograph is still required for the adjudication of the I-129F, so if it is missing, it must be requested prior to adjudication."

Hey, did you get any response yet for your RFE?

None yet!!!! Its been 13 days since they received it (inc weekends) so hopefully it will be sometime this week, but it says on the receipt on or before June 29th :(

Hi, So I am just reading this now. We did the EXACT same thing. We got our NOA-1 on 4/22. We should be prepared to expect an RFE soon I guess. :(:(

I am going to get the letter from my fiance so we are ready to send it right back.
