Confused 100% or 125% Aos??

I'm confused in regards to federal poverty guidelines income . Does the petitioner only need 100% of the federal guideline for form I-134 and then 125% when it comes time for I-1864??

This answer will make a huge difference to me so pls help with accurate answers!

Yeah I saw that and was confused cause I'm not in the military and it's not for a spouse or child it's for fiancée. So it's still true 100% for k1 and 125% for I-864?

It will depend solely on the CO at the K-1 interview. They have leeway when dealing with the I-134, and the decision as to whether or not they feel the intending immigrant will become a public charge is completely up to their discretion. Some will want to see the 125% because they know you will need that amount soon after entering the US when you file for AOS. Some will accept only 100%, since that is all that is required for the I-134. Some consulates are more stringent than others.

You can try researching reviews for your consulate to see if it is ever mentioned whether or not they readily accept 100% for a K-1.

If you're on K1 stage at least 100% but if applying already for AOS it is 125%.

I-134 = 100%

I-864 = 125%
