I am the petitioner. have been stuck on the affidavit for the last 2 months and this is why I haven't sent in my application yet and it is driving me nuts. It feels like I'm never going to get it done.

Maybe someone can give me some suggestions so I can finally get unstuck and get the ball rolling with this visa!

First of all, his forms are dated from almost two months ago now, is that going to be an issue?

The big issue...

I am self employed, and I grossed $20,000 this year on my 2014 taxes. Technically, that is 125% of the poverty line, but it doesn't say if it is GROSS income or NET.

I have one car, worth $20,000 and I have just a few thousand dollars in the bank. I wasn't sure if this would be enough evidence that I could support him, so I was planning on attaching my taxes from this last year but I thought it would be safe to have my sister co-sponsor just to be safe.

I know she needs to fill out a form i-134 but we want to know if we need her to submit ALL A, B and C (on the instructions for i-134f) for documentation. Is a letter from her employer enough? What about a letter from her employer AND taxes just from the last year? Can that be enough or does she ALSO need to get a letter from her bank, because she said she doesn't keep much money in the bank. Is just last year's taxes alright or does she need to go 3 years back? Basically, how much documentation does she need to submit for evidence for the affadavit?

Also, I am going to move to Australia for 6 months starting in July so that I can be with him while the k-1 is pending. Is this going to be an issue that I am going to with him in his country while the visa is being processed? I am mailing the visa while I am here in the US but then I'm leaving the country a few months later so that we can be together while the visa pends. I thought I would put my parents address on all of the forms because I am moving soon.

Please help if you know anything about this!! I would appreciate it SO much!

Don't overthink the I-134. The suggested evidence in the I-134 instructions are NOT requirements, they are merely suggestions of evidence you can use. The I-134 is asking for your current annual salary, which is your GROSS income.

For your I-134, since you are self-employed, you will use the amount on line 22 of your most recent tax return as your income. You cannot use your car, since it is the only car you have. The few thousand dollars in the bank prob isn't going to make that much of a difference. It sounds like your $20,000 income is enough. Just include a copy of your entire tax return, including all worksheets and schedules, with the I-134.

If you are using a co-sponsor, the same thing will apply to her. She will write her current annual salary. If her annual salary is sufficient then no need to list assets. She should also have her most recent tax return, and in addition an employment letter and a few paystubs.

I-134 it is needed for interview no to send the petition.

You can send the petition and when the interview come then you need fill out the afidavit form.

You are losding time, you could send the petition and think in afidavit later.

Agree with Zedyan.

Also the affidavit is for the interview not to be sent with the I-129f package so you can send it now as you never know how long it will take to be approved.

Also there are no problems with you visiting Australia for 6 months but how are you going to earn income in that time?

I believe you're from CA? So therefore you might get sent to CSC. Which means your application could be approved within a months time.

You should think about time lines and if you are sending it a couple of months before you visit in July then it will probably be approved before then.

Fiance(e) visa is a 2 step process.

First, USC petitioner files I-129F and when that's approved,

next foreign beneficiary files K-1 visa.

It's when the foreign beneficiary goes in for K1 visa interview

when I-134 and other supporting documents are needed.

So you don't need I-134 for I-129F packet,

but it's good to get that prepared soon...especially if you are going

through CSC processing center.
