Interview location

Hi

can I change location of our interview after AOS package is sent? And can i finish It from USA since we are so close to finish. My home country is one of visa waiver countries so I can stay in USA 4 month on visa waiver. We have emergency to travel to USA and it would be huge waist of money if I need to go back to original location just for the interview.

AOS as in Affidavit of Support? Are you filing from China and you are asking can you move your interview to the US? If that's the question that would be a no.

You would have to return to China when you interview is scheduled.

so - the beneficiary is not chinese? yes? no ?

if no, and you want to adjust in the USA -

then

send a copy of the I-130 approval notice,

plus an I-485 and the fee (plus I-131 and I-765, fees for these waived when filed with I-485)

plus a cover letter stating you wish to stop consular casefile processing and start an adjustment of status,

all into the USCIS lockbox address listed for 'concurrent filing'.

Beneficiary is not chinese and we are done with USCIS long time ago.

Now just dealing with NVS and waiting for them to announce our interview date. We are in China right now. But have to go to US soon for personal reasons. We still have 3 more month planned in China. And We ask this question just becouse We want to be prepared and know every possibility what could we do if interview will not happen until our personal deadline in China. I just want to know can we do the interview in USA instead of China. So it would not be going back just for the interview.

Because you are not currently in the US, the information in post #3 is not applicable to your situation and should be disregarded. Using the VWP with intent to immigrate is fraudulent. So no, the interview cannot take place in the US.

If you are running up against a deadline before needing to leave China, request an expedite.

Ok got it. Thanks for your answers! So we will just hope to get everything done in 3 month! Xoxox! And will try to stay positive ..even if We will need to come back for interview it's not the end of the world!
