I-130 Section B Q#2 Address

Hello,

I'm currently trying to get a CR-1 visa for my Japanese wife. We're both living and working in Japan right now and we're getting the I-130 package together.

I just had a quick question: For i-130, section B (Information about you), #2, address - should I list my permanent address back in the states (where my family excluding me lives,) or should I list where I'm currently living and working with my wife now (Japan)?

I read that some people listed their address back home, even when living abroad, because it looks better for establishing domicile status, while others disagreed. I think it would look confusing too if I listed my U.S. address in #2, and then in #21 (last address of where you lived with your spouse) to list another different address (while indicating "from xx to present".)

Could I have some more opinions on this please?

If you are currently living in Japan then state that. Domicile doesn't even start to become an issue until the AoS at the NVC stage. Even then the final determination is made at interview, if you haven't moved back to the USA by that point.

Plus a lot of people seem to get expedited when the USC is living abroad. I think you can even ask for it when you're living abroad.

It's an unofficial auto-expedite. You cannot ask for it. It may or may not happen and the USCIS will deny it exists if you ask.

Hello all and thank you for the responses!! I understand what to do now, so thank you.

I have two more questions if I may:

1) For #22 on the I-130 form: "Complete the information below if your relative is staying in the United States..." since we are both living in Japan, I think we should we write N/A here, but my question is, for the part next to that box: "If your relative is not eligible for adjustment of status, he or she will apply for visa abroad at the American consolute post in..." should we write Tokyo, Japan? Sorry if that's confusing but I hope that it makes sense.

2) Regarding the G325A - employment for last 5 years. My wife's contract with the public school she's employed with expires at the end of March and her next school starts the first of April. We want to finish assembling the package and send off everything probably about March 20th or so.... Would it be better to just go ahead and list her next school as "Present?" She's already had her interview and been accepted after all. Please let me know what you think.

Answers:

• Write Tokyo Japan on the right two lines.
• The form needs to accurately reflect what the situation is on the date it is signed. If she not yet at the next school on the date the form is signed and the package sent off, do not list it.

Could you please tell us the appropriate steps to take after her school changes then? Will we have to let the application run its course, and perhaps at the interview stage mention the change of job, or is there some other way?

Situations change all the time, it's not a big deal. When the time comes to complete the DS-260, the new job can be listed then.
