8 posts in this topic

Recommended Posts

Just received EAD today with no reentry to US as didnt file AP with it originally...

Anyone filed AP after receiving EAD card? Do you still pay for it? What documents needed?

How long will you get AP?--90 days from initial filing date or the last one you filed AP?

Need to travel back to see my family. Help needed!!!!

thanks!!

I think since you didn't file it with your AOS initially you actually have to pay the application fee, I think it's $360. It should take the same amount of time EAD usually takes, up to 90 days from when you file it. Here are the instructions.

K-1

I-129F NOA1 => NOA2: 161 days

NOA2 => Interview: 64 days

AP: 33 days

Total: 258 days

AOS

I-485 NOA => GC: 333 days

No Interview

With a k1 visa you can apply for EAD after AOS without paying as log as you send it with your noa1 from AOS.

I don't know if it's the same for a H1B visa.

I don't see why it wouldn't be as EAD is free with AOS.

Hopefully someone else can confirm that, I couldn't seem to find anything when googling.

You were right (at least for the K-1), my apologies. See this link, I wasn't able to find a topic that had an update though and I couldn't find anything on H1B, but hey give it a shot.

This is why the advice is to ALWAYS file for both EAD and AP when you submit AOS packet.

They are both free AND even when you think you will never need either . . . you just might.

yes, my bad...i underestimated the processing time for GC and thought I dont need to travel in 3-4 months....

Just filed my AP today....maybe another 67 days before I get the document

Also, my I-485 status shows I should be hearing something before March 29 ..2 months after my RFE response date....

how many days after EAD did you guys receive the interview notice?
