Hello I as most of you know I filed for the K3 back in June 2006. When we started the process USCIS did not request for evidence similar to that when filing for a K1. Now that has all changed and spouses are required to send in evidence even if they have not lived together just like the K1.

We are on 200++ days and still no approval. Since things have changed and things are taking way over normal processing times for us: Do you guys recommend I put some sort of package together and send it in requesting they append the new evidence to my existing applications? When our lawyer sent the paper work she did not include any form of evidence in either the I30 or I-129F. I’m wondering if I should print out a few hundred emails, phone records and a couple thousand photos, and some utility bills that I had connected under our names when I was living on my own for a few months. Oh yes and maybe copy of our health insurance too? I even copies of plane tickets, itineraries, and even and letters and cards sent via snail mail. What do you guys think please give me your feed back. For all those that are married and filed for the K3 did you send in evidence of any form? I gave my lawyer all this evidence last year but she said it would not be necessary till we went to the interview. AGGGGGG What would you do in my situation if you waited for over 7 months with out an approval? Would you go ahead and send in some form of evidence or keep waiting in limbo. I have written to my senator and congressman and I have put in 4 requests with the USCIS letting them know my cause is out of normal processing time but still nothing, not even an RFE. =0( Should I be proactive and do this or will this just complicate things more, or is this just useless? Should I wait for them to send some sort of RFE if they see that we need it?

I can't believe they still haven't done anything about your case. It must be insanely frustrating for you both. :(

There isn't any evidence that they are retro-dating the new evidence requirements for the I-130, or, at least, no one here has mentioned it. I'm sure there would be an uproar if they did. I didn't send any sort of evidence, except for our marriage certificate, with my original application, and none was ever requested.

It's tempting to send evidence in in anticipation of an RFE, but doing so would be pointless. They will contact you if they need anything, and your sending in unrequested evidence would be fruitless and possibly cause some minor confusion or annoyance. Of course, it's great that you have all that evidence, because it will be useful for your husband's interview.

I really, really hope you hear something soon. And it sure as hell better be good news after the long wait you've had.

dip_sticks, I feel really bad for you. You have been waiting for a long time. I think there is no need to send any sort of evidence, because you are married. These proofs will be needed for your husband's interview. I did not send any evidence of relationship with my cases, except for the copy of our marriage certificate.

First, it is unfortunate this happens. It's shameful of our government, I think. I've gotten two touches the last two days and I call to see if they can tell me any news, and of course they don't tell anything except what's on the site, which is 3 month old info. Same will probably happen if you call them, too. How much more horrible can customer service get with these guys!!?? And to think I had to pay nearly $400 for this...

What did I send in? I'm married and I sent a copy of our Chinese marriage certificate, which is actually a book with a picture of my wife and I together. I also sent a copy of our marriage 'mini-book' translated into a sort of normal sized book with english/chinese translations notarized by a government agency in China. I did not send, as it was not requested, any sort of pictures of us at the wedding, etc. Everything else was the normal goodies, eg, passport photos, docs, bribe money, the usual.

If you've watied past their time line, the site says you can call and inquire. I'd do that if you haven't and at least make sure your case hasn't already been denied and you were not made aware of it (eg RFE sent to wrong address).

If that's not the case, I'd do an address change (I think you can do it online now), so that will at least get your file looked at and possible processed and when someone sees the date maybe they'll push it along if they see something wrong with it. Sounds far fetched, but what else can you do? Join John Walker Lindh in Afghan? :unsure::hehe:

Seriously good luck, because I know like everyone else, this is emotionally straining on one's relationship, possibly borderline human rights interference.

If you send evidence without an RFE, it's extremely unlikely it will ever match up with your file.

Writing to senators won't get any result since you need to send in the privacy form before they can do anything. If you have already done that, have you called the senator's office to speak directly with the person asisgned to your case?

Yes I am aware that writing to the senator and the congressman requires sending in a privacy authorization form. And I have already done that as well as sent all the requested information. I have taken all those steps and I have also kept calling with follow ups but, unfortunately they still have not received a response and thus have no answer for me. I was told it takes about 60 days to hear any thing.

I would contact your other senator as this one isn't do anything for you that you cannot do yourself i.e. call USCIS and be told to call back in 60 days. The whole point of contacting an elected official is to get their assistance in finding out what is going on in your case.

During the IMBRA delay I spoke with one senate contact who told me to wait 60 days. I contacted the other senator's office who was on my case within 3 days and in contact with me throughout the next four weeks. When she became overworked and unable to assist me in a resonable time frame, I contacted a different office of the first senator who took all of my information and evidence to his supervisor, who spoke with the service center, and who pushed my case through.

If you don't want to sit back and wait for another 60 days, it would worth your time to try contacting another office or the other senator. Just my 2 cents - I wouldn't put up with that kind of response.

Hmm. I sent in a copy of my entire evidence file to both the I-130 and the I-129F. My I-130 was approved in about 80 days and the I-129F was approved in about 70. It was a HUGE binder of stuff, one of those 8 inch binders? I sent in a lot of stuff, way organized with tabs, etc because I had heard from others who had filed it was a good idea to send it then when dealing with a MENA spouse. I filed in Feb/Mar of 2006. My big wait has been the embassy in Amman which is slow-- I got through the US pretty fast.

None of my posts have ever been helpful. Be forewarned.
