Ok my wife and I got married the wrong way u see she came to egypt we got married and that's it no wedding nothing just a simple marriage in the department of justice in Cairo egypt ok and then she went back to the USA she worked hard and I was depending a lot on the visa to come that I will go there and support her but in Egypt iam just a poor simple man now we went on with the visa and did every thing the right way of course and it took us quiet some time for the uscis approval and then the national visa process and then Our big interview of course it went like hell on me I never thought it would now before the interview me and wife agreed to have a simple wedding in Vegas and spend sometime togther from the craziness of the paper and the regime and the papers and all ok now that was all ruined and the case went back to the uscis it is been there for 4 months and she say I won't take a single day for ur visa no more now she is a bit sensitive about the wedding and the idea of having a wedding dress and hold the flowers is important just like any other girl last night she said to me she said to me let us get divorce and do everything the right way like the wedding and instead she come we have some fun take some pictures and apply for k 1 visa and get married in the USA note ( we have a big age difference ) that all I can say right so I want ur opinions on how to act

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

I wish i had anything to suggest you. I dont 'coz i am not sure.

We also have big age gap. And not only that she earns way too much than me. And we also have simple wedding at court house only. And we both also dont like to be clicked so much. We too are scared and nervous and worried. At presnet we are doing all we can to gather as much evidence we can. But at the same time, if if they deny the visa, we will stick by each other.

Getting divorced and then trying to go the K1 route will only backfire in a big time way; don't go down this road

What your wife is waiting on right now from USCIS is for them to decide what to do with the petition. One of two things will happen:

  • USCIS will reaffirm their original approval of the petition with no additional information or action needed from your wife.
  • USCIS will send your wife a Notice of Intent to Revoke (NOIR).

The second scenario (receiving an NOIR) is more likely to occur. If and when your wife receives an NOIR, it will specifically state the reasons why it is being issued and it will also have a deadline as to when a rebuttal will need to be received by (usually 30 days).

An NOIR rebuttal must specifically rebut the reasons in the notice.

Once USCIS receives the rebuttal, they will render a decision (reaffirm or revoke). If the petition approval is reaffirmed, then the file will be returned to the Embassy for another interview.

It's important to know that a proper response to an NOIR does not guarantee reaffirmation. Also, reaffirmation does not guarantee a visa will ultimately be issued.

we are waiting for the reaffirm or the denial now but it just taking quiet sometime and to be quiet honest my wife is not real fighting for me so I guess that's it we will just get divorced and get separated it is a good thing to do right now

If you get divorced then it will all be over. You won't be able to be petitioned again by her and have them believe this is a legitimate relationship if you divorced each other and then get together again later. They have already denied you at this point. If you and your wife want to be together she will have to respond to the decision accordingly.
