February 2015 AOS Filers

We called USCIS today and requested expedited processing on my wife's I-131. The person I talked to said the reasons for the request met 2 of the criteria required and didn't indicate there would be any problem. This evening I checked the case status and it hadn't changed, however under case history it now says:

    We're trying to decipher what this might mean - anybody know?

We haven't heard anything yet. They told us we should hear something within 5 days, also they didn't mention anything about submitting any evidence.....so, still waiting.

Well, we received a letter from USCIS today requesting additional information to make a decision about my wife's AP expedite. My wife's mom had died and her house needs to be put in my wife's name now. There's a certain amount of time to do this determined by Ukraine law and the deadline is getting close (May 6th). My wife has to appear in person as it can't be done long distance over the phone.

When we called USCIS we were told that 2 of the criteria would apply (only need 1).....so it looks like we have to have a copy of the death certificate and a letter from the Ukrainian attorney stating what the Ukrainian law is, oh, and full translations of both. What makes this frustrating is that May 6 is also the 90th day mark from the AOS filing date - so they wouldn't even be expediting that much!

@czechtn I would apply for jobs right now. Generally job search takes some time and even if you're interviewed the process of multiple interviews, offer letters etc can take time. Weeks at a minimum, which puts you in a good spot to get EAD in time. Worst case scenario is you tell the prospective employer what your situation is and ask to delay start date until EAD Is received.

Hello Fellow Feb filers,

Today we received our RFE and it says my sponsor does not meet the 125% required income. We have 87 days in which to supply proof of additional assets or find a co-sponsor.

A bit confused as we sent in Pension statement which far exceeds the difference for our 125% shortfall

Hello Jwen,

sorry to hear about the RFE, we are expecting one too.

I was told by an immigration specialist that when their office receive a RFE and they believe it was not justified, they just simply resubmit the application with an explanation and in 95% it goes through. However, majority of RFEs are justified so just make sure that your Affidavit really adds up. Just my two cents.

Well my understanding of the difference is three times the shortfall so what submitted should be sufficient. But will look at it again tomorrow.

Presently am more anxious to have EAD approved so we can get SSN for the K2ers and file our married filing jointly taxes and get some refund.

Plus with this approval comes an immediate work opp, ability to get drivers licence, state Id, etc..

I read that you cannot claim a spouse as a dependent. I saw this on the IRS website

Your spouse is never considered your dependent. On a joint return, you may claim one exemption for yourself and one for your spouse. If you’re filing a separate return, you may claim the exemption for your spouse only if they had no gross income, are not filing a joint return, and were not the dependent of another taxpayer.
