No one knows for sure how long the process will take for you. If you look at other people timelines that is similar to you it will give you a rough estimate on the time you can expect. However it is only an estimate your process could be faster or slower. When the Obama immigration reform takes effect it could effect the process as it will increase the workloads. will it affect some or all no ones knows. Will it increase the chance of your visa process taking longer most likely yes but again no one knows for sure. Whether to file now or later is a choice you will have to make base on your own reasons.

Theoretically, you can file all the paperwork now and go through the process of obtaining the visa…but only use it when you're ready too. If that makes sense. I think the visa itself is valid for 6 months and of course you have that 90 day period to actually get married etc.

On the other hand, I wouldn't suggest rushing your relationship etc based upon the visa process. So file when the two of you are ready. If it takes a few more months so be it…you have the rest of your lives to spend together. :)

But if you are engaged already, then I would say file asap lol.

Hi everybody :)

My question is this, I am a Canadian citizen and my American boyfriend and I are planning on starting the K1 visa process this summer. I haven't worked for some time due to personal issues and I'm just wondering if my current employment status will be a factor at the time of the interview? In basic terms will the fact that I am unemployed at the time of the interview effect anything as far as us being able to get the k1 visa?

Your current employment status has no bearing. The Petitioner (your boyfriend) must show the ability to support you and him. It is assumed that if currently employed you will be leaving that employment when the Visa is approved.

Thanks j&ana, well I sure hope it doesn't :( It would be nice to have an estimate of how much longer it would take after the immigration reform takes effect so we could weigh out the options.

Hey guys!!!!

I might make another post about this later but for now I'll just ask on here. I'm not going to go into too much detail about the specifics of my situation and instead I'm just going to ask the question in very general terms and if I need to elaborate more later on I will. Here it is - Will there be any problem with someone getting a visa because they have anxiety and depression? I've heard that someone can be denied a visa because of mental illness but I have a feeling they're talking about severe mental illness and not just anxiety/depression correct?

(Assuming you are referring to the beneficiary) When you have your medical for the K1 visa, you will need to be honest about this and take a letter from your doctor regarding your anxiety/depression. This letter must include the phrase "they are not a threat to themselves or others" and then everything should be fine. I'm sure others with more personal experience will weigh in also, but I have read this several times on VJ. Good luck.

No it doesn't matter that you the beneficary are not working, all they need to know is that your partner the petitioner has enough income to support you and themself. If your partner doesn't meet the poverty line of $15,100 then you can get a co-sponsor, which can be one of his relatives or a friend, they would of course need to be a US citizen and living in America.

Here is what the medical exam entails, and the above info is spot on. You can provide a letter from your doctor stating that your condition does not effect your normal well being or ability to function normally. Stating that you are not a harm to yourself or others is quite helpful to include in your doctor's assessment of your condition.
