hello everyone, i am new to this and looks to be an interesting ride...first of, thank you in advance for any help or advice, as i am sure all you know, it is hard to be away from the person that means most; i will try to help when i can...and away we go...

somewhere in the forms to be filled out there is a question about the fiancee working or attended school when they get to the states...and that it may be asked at the interview...i would think that the obvious answer is "yes", but i heard to say no to thses questions...any input out there???

Can you tell us what question you are referring to? I do not remember this question being on the I-129F form. Your fiancee will most likely not be able to work right away after coming into the USA. She will need clearance to work.

Jan 17, 2007- I-129F has arrived at the NSC

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

There are pros and contras about this. But I thought the question was not on I-129F but on DS 156? Or....maybe I totally forgot about it...

Anywayz,

If you check on the "example forms" on VJ, it's typed "With Work Authorization, Employer Unknown" there. I typed that too on mine. I have a plan on going to uni there too but since we're not sure when I could do that, and we'd rather have me workin a.s.a.p instead, I ticked NO on the question about schooling. If they asked about it, I'd just say I plan on workin in the USA after I get married to my fiance and get my EAD. I dunno if doing it this way would help me get the temporary EAD on POE. But I don't think it matters anyways.

If you're not sure, you could just tick NO on both of the questions. I don't think they would ask about it. Even if they asked, you could say you don't have any plan to work nor go to school there. If you decided to work/go to school in the US later on, it wouldn't be a problem. They wouldn't pull that #######. Excuse my language.

It's not on the I-134 form - the OP must have made a mistake. I marked "with work authorization" as well. When you mark that your fiance will work and/or study in the U.S. it is not showing that s/he plans on coming here just for a work visa.

I believe it shows that s/he plans on making a life for him/herself here. Of course my fiance is going to work - he's not going to sit on his butt all day ;)

Don't worry about it. Be honest.

It's not on the I-134 form - the OP must have made a mistake. I marked "with work authorization" as well. When you mark that your fiance will work and/or study in the U.S. it is not showing that s/he plans on coming here just for a work visa.

Since a K-1 is employment authorization (EA) incident to status for 90 days, then I guess I don't understand why answering YES would be a problem.

I believe my fiancee checked yes on his and just put will work with when in eligible status or something close to that. He just filled out the DS-156 form yesterday Ill ask again today and see what he put for sure.

This is an interesting topic that I've thought about. I am not sure whether to list my fiancee' is going to work upon arrival. I'm self-employed with 2 small businesses. I have no employees who work for me. I can easily list her as being able to work for either business doing secretarial work if she wants. Of course, I have not submitted the documents that ask the question if she will work here. I'd be interested to hear some opinions about this whether I should state that she can work for either business upon her arrival or not. I'm guessing if I write "With Work Authorization", this will eliminate other documents that may need to be submitted.
