Hello. I'm in the process of bringing my fiancée over to the US with a K-1 visa from Romania (we became engaged this year and started the K-1 process).She was denied a tourist visa last year. At that time she didn't mention that she was coming to see me, she just stated that the purpose of her visit was tourism. Will they ask about this in her upcoming interview at the embassy? Will it be a problem? Also we have no set plans or dates for a wedding yet. We just want to do a simple civil ceremony for right now after she gets here. Is not having set dates also a potential problem? Thank you!

I was denied a student visa twice and never mentioned I had my boyfriend in the states. (Wasn't asked so didnt tell them)... I' was given the 214(b) denial (lack of home ties) .. Had just been coming back from the states after two years when I applied wich I assume was the problem sort of. Anyway, I'm in the process of a k1 visa now and I've been told that previous visas/denials shouldn't affect a k1 visa.

We don't either have any specific wedding plans other than a dream of a beach wedding but I'm assuming that the embassy's knows it's hard to plan a big wedding when you don't even know when you will be issued the visa.

There might be some questions. It depends on exactly how the question was asked and answered when she was denied.

FOr example, if she was asked whether she had a boyfriend in the US (notice not using 'visit') and her answer was no; then I'd ask about the time you claim to have met her, in the K-1. You know where I'm going, right?

The raw timeline you noted on your post supports that 'tourism' was likely the best answer though, and very probably no questions will come up.

If the question was merely 'purpose of visit', tourism is more or less safe; but a follow question could be "how come you were not planning to visit boyfriend/fiance?" for example.

Thread carefully, you never want to lie to an immigration officer or in an immigration form/petition.

Not saying she had lied on purpose of course or at all for what matters, but you need to realize that anything she answers in a form or to a person is documented.

Not to say that you need to panic either, but be precise in the answers provided.

dont worry there is no problem, there are many romanians that were denied for a tourist visa but aprooved with a k1...it has nothing to do one with the other so good luck!!! and dont stress if she would aply now for a tourist visa while ur petition is submitted they would aproove it for a short time as long as she would come back for the process

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
