DCF abroad or AOS here in USA?

I assumed VWP, not that it matters either way.

I think with VWP you cannot overstay. Also he mentioned he is here on a tourist visa that expires in FEB'15. Isn't VW only a three month entry?

In the end you are right... won't matter. He can adjust status without worries

Only difference is should something go wrong, entering on VWP is Under the VWP an applicant waives their right to defense in removal proceedings before an immigration judge if inadmissible or deportable except in the case of Seeking Asylum in the US.

My spouse applied for me and I was denied based on the fact that name of the mother of tmy twin boys was on my visa application back home @ the U.S. embassy. I was never married to her formerly.

A friend back home helped get a letter from the marriage registry to the effect that I was never married to her formery. It was discovered upon verification that the document was a fake. I appealed the decision and the case was sent US Dept of Justice (Executive Office for Immigration Review). I last heard from the Immigration June 28, 2012, a reply to the appeal.

The last two paragraphs of the letter reads thus: "On remand, both the petitioner and the DHS should have the opportunity to submit any and all available relevant evidence regarding the Nona fides of the marriage. We make no determination on the merits of the visa petition.

ORDER: The record is remanded to the Director for further proceedings and issuance of a new decision."

And to the OP: on my first go-round on immigration to the US, we were adjusting from the VWP after having been in the US for about two months. A lawyer told us to just go for it on our own, and we had no hassles until we decided to abandon the process and move back to the UK. Most stories you'll find on VJ about this topic are pretty similar. Good luck! :)
