Do i need anything else to travel abroad?

Hi,

Probably a stupid question, but I just want to make sure...Planning on going abroad, I have my EAD/Advance Parole, which lets me travel abroad, but do I need anything else extra? I'm going to take my 1485 NOA with me, and my status update letter as well just in case, but I don't need to get a Visa Waiver or anything else like that to re-enter the US do I?

I am seeing this more and more.

The AP IS NOT for general travel to / from the United States.

It is for emergency situtations only.

You are taking a risk treating the AP as a green card.


Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

Yes I personally would just use AP for emergency but I see people using it to travel all the time and have no problem... But remember it's up to the officer at POE to let you back in the country.... Your entry is not granted because you have AP! The letter you received with it explains it.....

Answering your questions :) I would also bring a copy of your marriage certificate

AP is for travel while you are waiting for your GC. What else is a K-1 visaholder supposed to do while they have to wait approximately 90 days after the filing of the I-485 just to get the GC if the USCIS was living up to there processing times--which they are not. The AP form is a multi-purpose form and as a former K-1 visaholder you can apply to be allowed to re-enter the US using AP for normal travel. Expect to be taken into secondary inspection and allow plenty of time for that secondary inspection. The USCIS does state in #3 of the instructuons how the AP works for as Avande Parole and does have a warning about re-entry not being guaranteed.

With all things in immigration it does depend on who you encounter at your POE, but you should be fine. There are stories of people having no issues and some of people having problems. YMMV. Just be prepared for the worst, stay calm, and be pleasant.

Take your AP, your passport, the K-1 visa if it happens to be in a different passport, a copy of your Marriage Ceritifcate amd a copy of the NOA1 for the AOS just so you are prepared.

Thanks. I thought I had seen people use it for normal travel. Figured visiting family during the holidays would be a good enough reason, especially as I'm still waiting on my GC as I'm out if normal processing times.

I know you're not Garunteed entry, but that's the same with the green card and any visa. I'll just bring my notices, letters and my k1 with me to be prepared.

Did you have to do anything with the advance parole before you left? Did you have to inform anyone, or show anyone the card?

before you leave, you don´t have to inform anyone or do anything with your AP EAD card, while leaving the US they do not ask for any documents. When turning back to the US you´ll need EAD AP card and marriage certificate (I personally had with me all the docs and letters from uscis since I started the AOS).
