I perhaps have outdone my posting for the week but again, trying to finalize everything and this community is the best support system I have. (Thank you).

I have had mixed responses (some say list and some say don't) and just got off the phone with USCIS (no help, obviously - at first he told me no don't list it but then said I can't give you the correct information and to consult a lawyer) trying to figure out whether or not we should fill out the Information of Alien Fiance Child portion of I-129F if NOT petitioning for the child to come to the U.S. My initial thought is yes you list the child because he has one? My fiance has 1 child under 21 that he pays support for regularly, but we are not going to petition for them to come to the U.S. as he is not involved outside of paying child support. On the i-129F instructions it says: "If the children of your fiance or spouse did not derive U.S. citizenship, and they are unmarried, under 21 yeas of age, and listed on this form, they will be eligible to apply for a visa to accompany or follow to join your fiance or spouse."

Does that mean we don't list the child if we aren't going to petition as such? Or would not listing the child cause problems because technically he has a child and if we don't list it, it would mean I am saying he doesn't have one when he actually does?

Just would like some clarity. They ask for the current address of the child was has been hard to track down because in Costa Rica you just pay child support through the bank. I'm wondering if I'm trying to get information that isn't even required...
