This is not a recommendation to anybody, but I was wondering whether, given that decisions are guaranteed within 60 days after an RFE, whether it isn't a good idea to deliberately mess up something basic, get an RFE, and then get a decision within 60 days?

This is based on pure empirical review of VJ Similar Timelines and people who had RFEs whose petitions were approved at the same Service Center faster than our 'clean approval' was processed.

Remember, I'm not suggesting this, but just wondering.

Thoughts?

First decisions are not ever "guaranteed" within a certain period of time. Second the decision could be a denial.

An RFE is generated when the case is looked at if something is deficient. It might be 6 months before the case is looked for an RFE to be generated.

Well first off, a decision is NOT guaranteed within 60 days after an RFE. It is usually the case though where a decision will be made within that time, but the adjudicating officer can take much longer than that. You only need to have your RFE response returned within 60 days.

Second, if you give an incorrect RFE response, deliberate or not, it will usually be reason for denial of your petition.

Well I don't think it's a good idea at all. First of all it doesn't seem right and as mentioned before it's not guaranteed a decision within 60 days! Some people get RFE after 5 or 6 months and if they didn't have it they could have been approved by the time. Never take the risk to have your petition denied!

Not a good idea. Always better to do it right the first time than to risk prolonging the whole process because of deliberately making mistakes.

You also run the risk of USCIS claiming not to receive any response regarding the RFE from you and getting DENIED because of that. This has happened to a lot of people.
