Hello VJ !!!

I will ask again same question because first time I dind't understand so much so there's the question : " Can I apply for AOS after my I-94 expires? "

My I-94 expires on 11 December, we will get married next week, but for the moment we don't have money for AOS ( $1070) ... so I want to know if I will have problems if I will apply late.

Yes, you can. As long as you married within 90 days.

Timeline

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

I sent in my AOS after my i94 expire about 4 days late... But married within 90 days.. I received my EAD without problem... Still waiting for i485 interview though...

AOS from K1 :

Date Filed : 2014-09-08
NOA Date : 2014-09-16

Bio. Appt. : 2014-10-09

Early Bio : 2014-10-03

EAD & AP Approved : 2014-10-15

EAD & AP Received : 2014-10-23

Interview Waiver letter : 2015-02-25

Service Request via phone : 2015-07-24

Welcome Notice was mailed : 2015-07-30

Green Card Received : 2015-08-24

I sent in my AOS after my i94 expire about 4 days late... But married within 90 days.. I received my EAD without problem... Still waiting for i485 interview though...

Just plan on a long wait. We're still waiting.
