Packet 3 Requirements

Timeline

I am trying to gather all the required documents for my Packet 3 since my case is IN TRANSIT from the NVC and I have a question. Do the last three years of the petitioner’s federal income tax returns, supporting W-2 form(s), and IRS-issued proof of payment have to be originals or copies? I am a little hesitant to send the originals since I only have one copy of them but will send them if they are required.

If you provide an IRS transcript, then you don't need a copy of the tax return. It is either a copy of the complete tax return with all forms, schedules, W-2s and/or 1099s, or an IRS transcript. As I said above, copies. Copies of tax returns or transcripts and copies for proof of income such as pay stubs. The I-134 is what needs to be original.

This is what I would do:

- Original - send IRS tax transcripts for the past three years.

- Copy - your recent paystub and W2

Though tax transcript is mother of all but your recent paystub will prove you are still workings. My lessons learned with immigration; it's okay to send what they've asked but it wont hurt if you send extra. But have to be careful with extra and relevant.
