There is no absolute response. It all comes down to the officer at POE. Even asking specifically about an airport is useless. Officer may or may not see this as an issue.

I am travelling to see my husband in Sf... my POE will be Dallas as I intend to spend a day there at the company i work for HDQ's, meet with colleagues and whatnot. Will I be successful entering with b1/b2? Only God knows. But I hope so.

I wish you luck and safe travels for your S.O.!

Best,

UnaMexicana

I always go through Newark and the personality differences between different officers are like night and day. I've had absolute robots, power trippers and hyperactive giggle monsters stamp me in, but my trips have always been rather infrequent and sadly short which is why I've never had trouble. Lots of people manage the 90 days in, 90 days out rinse-and-repeat thing though, look at Iggy Azalea for example. It's tough to accept, but you can't predict what will happen and will be betting your air fare and emotions on what one officer feels. Will it be worth it? It's always worth it for the chance to see your fiancé. If you don't try at all then you have no chance of seeing them.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Timeline

I used to come 2 times a year stays of 89 days and they were not ok with it the last times I came. I was never sent back to Spain but this last time in April they told me it was probably the last time they would allow me to do it, they called my husband ( then boyfriend ) on the phone to ask if everything I said was true.... And even told me while I was leaving tell him he needs to make a decision or next time you will be sent back.

I was retained for almost 2 hours, they were saying that VWP is for a vacation and I wasnt vacationing I was tecnically living here using a tourist document.

But that happened the 11th time I entered this country since my relationship started so it also makes sense and I understand they were suspicious ( I never ever worked or anything similar )

It really depends on the person you get at POE....just bring all those documents you mentioned and Christmas is a reasonable date to be together

I have to add people in southern airports are usually nicer... My worst experience was in Philadelphia

Agree with this, you might get someone who lets him through without many questions or you might get someone who has an issue with two long visits close together and decides he is abusing the VWP. Good luck!

l came through Detroit and l had a problem. My 2 visits were too close together. l was held in immigration secondary room for 2 hours

and treated like , like l was a convict. Luckily i was allowed through for 3 months instead of my intended 5 months 3 weeks. l'm on a b2

visa. To the topic starter, l see you have a fiance visa pending. You are gonna get problems on that alone.

That should not cause a problem. I contacted the London Embassy and they confirmed what many others have about traveling to the US while the K1 process in being progressed through the USCIS system. Here is their reply:

Thank you for your email.

You are not prohibited from traveling under the Visa Waiver Program (VWP) whilst your K-1 visa application is being processed, provided you are otherwise qualified. However, you will be required to show that your visit is temporary and that you have a residence outside the United States that you do not intend to abandon. However, if there is a pattern of frequent travel, the strength of your ties outside the United States could be questioned. If the immigration officers at the U.S. Port of Entry are not satisfied you are a bona fide visitor, you will be refused admission. Please note that as each case is different, there is no set documentation required as proof of your ties outside of the United States.

Sincerely,

Consular Information Unit

I am going to spend Christmas with my fiance and his family. I am not concerned. Just take proof of ties. The shorter your visit the easier it is. It will be my first visit since July when I was only there for 3 weeks and returned before we filed our I129F. It should not be a problem. I can't offer any experience from traveling on a visitor visa as I have never had one and that may have a different set of rules attached.

To the OP, your fiance may want to consider a shorter stay on this visit, though.
