We just received some news on my GC. My husband had inquired with our US Senator (Cory Booker) back in November about expediting my I-765 but we did not followed up on our request to the Senator and decided to just wait it out for normal processing. Turns out that the Senator did contact USCIS and we just received an email from the Senator's aid with USCIS response. Looks like I've been seleceted as a interview waiver with a 9 - 12 month wait for my GC.

"We received your inquiry from the Nebraska Service Center (NSC) regarding Case MSC*******, Form I-485, A# A*******, DOB */**/** filed by ********* that was received on 10/21/14. This case has been identified as a possible interview waiver case and is currently being held at the NBC pending a field office review. The interview waiver cases are being shipped to the local USCIS field offices for adjudication based on field office capacity and not necessarily office of jurisdiction. At this time the processing time is approximately 9-12 months from the receipt date. Once further action is taken on this case notice will be sent to the address of record.

A review of our systems shows Case MSC******, Form I-765 and Case MSC******, Form I-131 filed by ******** were received on 10/21/14. The current processing time for these applications is 3 months from the filing date. If ******* requests to have this case expedited, it needs to meet USCIS expedite criteria. Documentation that supports the expedite request must also be submitted at the time of the request. Due to the volume of expedite requests for this case type, we are strictly enforcing the expedite request criteria. We generally are unable to accept a letter from the applicant as the sole evidence that the criteria to meet the threshold for an expedite have been satisfied. Information regarding the expedite criteria can be found at the link"

I just called USCIS and asked for an approaching regulatory timeframe in my I-765 today, Does that means I am going to get a waiver too just cause I asked for regulatory approaching time?

My I-485 has just changed to scheduled for an interview on february 10

Thanks. I called this morning but I'm the petitioner so they said my wife has to call or be with me. They didn't want to help me. I'm at work so we'll call when I get home.

So for those asking about I-765 after 75 days, what you have to do is HAVE THE PETITIONER CALL, tier 2, give the receipt number, press the number for ''has a problem with petition'' so you gonna be directed to costumer service, then you say '' My Application to work authorization I-765 is past 75 days, I would like to REQUEST AN APPROACHING TIMEFRAME

That's what I did today, the woman from USCIS was very nice, asked a few questions about my info, my alien number, receipt number again, and then she said she created the inquiry for APPROACHING TIMEFRAME and gave me a confirmation number (which was too long and I think I saved the wrong number lol but ok)

Anyway my question is, Am I going to have problems or get a waiver just because I asked for that approaching timeframe thing? My I-485 is already scheduled for interview and i NEVER heard of waiver stuff, neither got one, am I going to get one just cause I called USCIS and bothered them with my I-765?

hey.. I've seen a couple of you mentioning Tier 2 rep. What does that means exactly?.. Is it someone different from the ones that answers or what?..

Thanks,

by the way, the lady told me that this won't effect other pending cases. It basically is just a follow up notification for USCIS.

Good luck!
